<br />002'1 <br /> <br />force and effect. The procedures appl icab1e to the foregoing <br />shall be in accordance with 7 CFR 15, and other pertinent laws <br />and regulations. <br /> <br />10. This grant confers no rights upon the Grantee to the use of water <br />involved; such rights must be obtained under State law. <br /> <br />11. This Grant is issued subject to the provisions of the Boulder <br />Canyon Project Act of December 21, 1928 (45 Stat., 1064), <br />particularly Section 13. <br /> <br />12. The Grantee shall have the structures inspected annua lly. The <br />inspection shall be made by a qualified engineer to ensure pro- <br />tection to the structures. Repairs shall be made in accordance <br />with recommendations by the inspecting engi neer. Aqua 1 ifi ed <br />engineer is one authorized to practice engineering in the State <br />either by reason of his employment by the State or Federal <br />Governmnet or by registration as provided by law of the State. <br />The engineer shall sign a written report of said inspection. <br />Three copies of each report shall be mailed to the Forest <br />Supervisor of the White River National Forest. <br /> <br />13. The Grantee further agrees that Forest Service Representatives <br />may inspect the structure at any time. If the Forest Service is <br />not satisfied with any safety, operation, maintenance, or physi- <br />cal condition of the structures and appurtenances, upon a finding <br />and written notice thereof, the Grantee shall comply with a re- <br />quest to correct, adjust, or change same. <br /> <br />14. The Grantee shall annually submit for Forest Service approval an <br />Operation and Maintenance Plan. This Plan shall include, but is <br />not limited to, the following: <br /> <br />a. The Grantee shall take necessary precautions to prevent <br />pollution of, or deterioration of lands, air, or waters <br />which may result from the exercise of the privileges <br />extended by thi s grant. The Grantee shall be responsib1 e <br />for securing any permits, certificates, licenses, or other <br />forms of approval required to comply with Federal and State <br />standards for public health and safety, environmental pro- <br />tection, siting, construction, operation, or maintenance. <br /> <br />b. The Grantee shall take such soil and resource conservation <br />and protection measures, including weed control, on the land <br />covered by this grant and which is affected by the construc- <br />tion, maintenance, operation, and repair of the project <br />facilities as the Grantor may request. <br /> <br />c. The Grantee shall not use chemical materials to control <br />undesirable weedy and herbaceous vegetation, aquatic plants, <br />insects, rodents, fish, and other pests without prior approval <br />of the Grantor. <br /> <br />5 <br />
