<br />THIS EASEMENT, dated this 16th day of May ,
<br />1983 from the UNITED STATES OF AMERICA, actin9 by and through the Regional
<br />Forester, Forest Service, U.S. Department of Agriculture, hereinafter
<br />called "Grantor," to the Cities of Colorado Springs and Aurora, Colorado,
<br />hereinafter called "Grantee."

<br />WITNESSETH:
<br />
<br />WHEREAS, the Grantee has app1 i ed under the Act of October 21, 1976,
<br />(90 Stat. 2776; 43 USC 1761), and under the Regulations of the Secretary of
<br />Agriculture, 36 CFR 251 (45 FR 38328. June 6,1980) for a tunnel, pipeline,
<br />diversion dams, and service road necessary for the collection and trans-
<br />mission of water on, over, across, under or through certain lands owned by
<br />the United States in Eagle County, State of Colorado, and administered by
<br />the Forest Service, Department of Agriculture.

<br />NOW THEREFORE, Grantor does hereby grant to Grantee an easement under
<br />36 CFR 251.53(1)(1) for a right of way for the construction, operation, and
<br />maintenance of a tunnel, pipeline, diversion dams, other related facilities,
<br />and service road on, over, across, under or through portions of the follow-
<br />ing described lands of the United States in Eagle County, State of Colorado:

<br />The area authorized by this easement is limited to improvement areas
<br />specified on a plat as submitted in the Design Report dated February 22,
<br />1983. The maximum pipe1 ine and road right-of-way width will be 50 feet.
<br />Copies of the above designated plats are on file at the White River
<br />National Forest Supervisor's Office, G1enwood Springs.
