Documentation will also be provided to the <br />Colorado State Historic Preservation Officer. For those significant sites which cannot be avoided <br />by redesign of the earriage Contract facilities, Reclamation will design and implement a <br />treatment program designed to mitigate the effects of the undertaking on the resource(s). The <br />treatment program will be implemented by the DWCD (in consultation with Reclamation) <br />utilizing a contract with qualified cultural resources specialists. <br /> <br />Since the new irrigation appears to occur exclusively on private land, any human remains which <br />are inadvertently discovered or unearthed as part of a controlled excavation will be treated in <br />accordance with existing Colorado statutes. <br /> <br />This document serves to consult with Indian Tribes and Native American groups which might <br />assign a religious or cultural significance to cultural resources located within the area of potential <br />effect. Indian Tribes and Native American groups are informed that the undertaking may result <br />in an effect to religious or cultural sites which these groups attached significance to, and which <br />may be eligible for the National Register of Historic Places. <br /> <br />Environmental Justice <br /> <br />The Executive Order on Environmental Justice is designed to protect minority and low-income <br />populations from disproportionately high and adverse human health and environmental effects of <br />Federal programs. The proposed Carriage Contract or the No Action alternative would not have <br />any disproportional adverse effects on these populations. <br /> <br />CONSULTATION AND COORDINATION <br /> <br />The Carriage Contract has been developed in cooperation with the OWeD and MVIC. <br />Consultation has occurred with the Service in regard to the Endangered Species Act. <br />Negotiations on the Carriage eontract, open to the public, began in July 1999. The Carriage <br />eontract concept and the DWCD's overall WETPACK proposals have been presented at a <br />variety of meetings including meetings of the Colorado Water Conservation Board and the <br />Dolores River Instream Flow Partnership. Meetings were held between the draft and final EA's <br />with Trout Unlimited and Environmental Defense to discuss Dolores River flows and with the <br />State Historic Preservation Officer concerning cultural resources. Water quality concerns were <br />discussed with the Environmental Protection Agency and they were provided draft comment and <br />response sections on water quality for review. A field review of the project area was conducted <br />with the Fish and Wildlife Service. <br /> <br />This fmal environmental assessment has been provided to the individuals and groups listed at the <br />end of this section. A news release has also been mailed indicating the availability of the <br />assessment. <br /> <br />Comments on the draft EA were received from approximately 50 individuals and organizations <br /> <br />18 <br />
