<br />suggested by the Chief of Engineers and accepted by the negotiating <br /> <br />commissioners that the Federal legislation ratifying the compact should <br /> <br />contain appropriate language covering the sovereignty and, jurisdiction <br /> <br />of the United States and the responsibilities of the Chief of Engineers <br /> <br />with respect to the compact. Accordingly, the follo~Qng provisions <br /> <br />have been incorporated in Article IX A of the proposed compact for <br /> <br />enactment in ratifying legislation by the Congress: <br /> <br />"This Compact shall become ef.f'ecti ve uhen ratified by the <br />Legisla.ture of each State and ';,-nSll consented to by the Congress <br />of the United States by legislation p,oviding substantially, <br />among other things, as follows~ <br /> <br />Nothing contained in this Act or in the Compact <br />herein consented to shall be construed as impairing <br />or affecting the sovereignty of the United States <br />or any of its rights or jurisdiction in and over the <br />area or waters which are the subject of such Compact: <br />Provided, that the Chief of Engineers is hereby <br />authorized to operate the conservation features of <br />the John Marti.n Reservoir Project in a manner c on- <br />formimg to such Compact with such exceptions as he <br />and the Administration created pursuant to the <br />Compact may jointly approve." <br /> <br />(c) Development of Arkansas River Basin <br /> <br />Of important long range interest to the United States, <br /> <br />particularly the Hureau of Reclamation and the Corps of Engineers in <br /> <br />planning the overall development of the Arkansas: River basin, are the <br /> <br />proposed compact provisions of Article IV D, viz: <br /> <br />"This compact is not intended to impede or <br />prevent future beneficial develop.c: '1+, of the Arkansas <br />River basin in Colorado and Kansc:,S u,\' Federal or State <br />agencies, by private enterprise, o~ oy combinations thereof, <br />which may involve construction of daJ1s, reservoirs, and <br />other works for the purposes of water utilization and <br />control, as well as the improved or prolonged functioning <br />of existing works: Provided, that the waters of the <br />Arkansas River, as defined in Article III, shall not be <br />materially depleted in usable quantity or availability <br />for use to the water users' in COlorado and Kansas under <br />this Compact by such future development or construction." <br /> <br />-17- <br />
