The
decision upheld a lower court decision that the Elephant Butte Irrigation District
was entitled to have funds generated from project lands credited toward annual
operation and maintenance of the Project. Something to think about. . .

State Legislative Issues- The CWC State Affairs Committee met
November 5 to consider growth and water related issues. Peter Nichols presented
his report "Water and Growth in Colorado" (Summary Report is attached) to the
State Affairs Committee members, The Committee then discussed the pros and
cons of changes to Colorado water law to deal with the issues raised in the
report. I asked the Committee to consider the issue of mitigation of ag to M&I
transfers. There was active debate on this issue among the State Affairs
Committee members. I asked the Committee to consider adding this issue to its
up coming agenda.

7
