The Court, having <br /> reviewed the motion and being otherwise fully advised finds as follows: <br /> 1. On October 28, 2022, acting pursuant to the authority granted to him under sections 37- <br /> 92-501 and 37-80-104, C.R.S., the State Engineer adopted the "Rules and Regulations for <br /> Governing the Measurement of Surface and Groundwater Diversions and Storage of Water <br /> Located in Water Division 6" ("Proposed Rules"). <br /> 2. The Proposed Rules are attached as Attachment A. <br /> 3. Contemporaneously with the State Engineer's adoption of the Proposed Rules, the State <br /> Engineer filed the Proposed Rules with the Water Court for Water Division No. 6. In accordance <br /> with section 37-92-501(2)(g), C.R.S., the Proposed Rules were then published in the counties <br /> where measurement of surface and groundwater diversions and storage, release, and delivery of <br /> water exist, and the Proposed Rules were published in the October 2022 resume for Water <br /> Division No. 6. <br /> 4. On December 29, 2022, the State Engineer filed a Notice of Filing Proofs of Publication, <br /> confirming that the Proposed Rules were published in newspapers of general circulation in the <br /> counties of Moffat, Jackson, Grand, Garfield, Rio Blanco, and Routt. <br /> 5. Under section 37-92-501(3)(a), C.R.S., any person desiring to protest the Proposed Rules <br /> could do so in the same manner as provided in section 37-92-304, C.R.S., for the protest of a <br /> ruling of the water referee. <br />
