DANIELSON <br />Secretary <br />PRC$LE lvl: <br />Occasionally, the staff has had problems with consultants and contractors constructing monitoring and <br />observation ho!es without giving three days prior notice, as required pursuant to Rule 12 of the Water <br />Well Construction and Pump Installation Contractor Rules. The reasons for requiring immediate <br />response is to define the nature and extent of a hazard and to prevent delays of remedial actions. In <br />these situations, three-day prior, written notice would not be practical or safe. <br />DISCUSSION: <br />The purpose of the three-day written notice is to inform the staff of when, where and by whom <br />monitoring and observation holes are being drilled. It also allows time for the staff to provide input to <br />the consultant or contractor, if required. While a facsimile transmission is a form of written record, it <br />is not an original document. Furthermore, not all contractors have ready access to FAX machines and <br />call the staff for verbal approval. In order to provide a quicker response in emergency situations, the <br />staff recommends that a facsimile transmission or verbal communication be acceptable as notice and <br />that construction may begin immediately. <br />POLICY: <br />Having considered the issues presented and desiring to provide for a quick response when <br />emergencies occur, the Board hereby adopts the following policy: <br />Receipt of a FAX transmission shall be acceptable for meeting the three-day prior, <br />written notice requirement. <br />When a facsimile transmittal is not practical, the staff may grant a variance and give <br />verbal approval to proceed with the construction of monitoring and observation wells <br />in emergencies. <br />In either case, the original notice must be submitted to the State Engineer's Office within seven <br />days after the FAX transmission. <br />The effective date of this policy is April 2, 1991. <br />Dated this 20� day of 1991. <br />V, �d _ <br />Ken R Ilin, Chairman <br />Board of Examiners of Well <br />Construction and Pump Installation <br />Contractors <br />Ken Rollin, Chairman, Longmont; Paul Berglund, Golden; George Meriwether, Monte Vista; and Glenn A.
