If the Diversion Structure is located in Division 7, even if the diverted <br /> water is exported for use in another Division, that Diversion Structure is subject to <br /> the Rules, including that it be equipped with a Measurement Method. The <br /> Measurement Method itself may be located in the Division of import if that <br /> otherwise complies with the Rules. <br /> Q: Do the Rules apply to wells? <br /> A: Yes. The definitions of "Diversion" and "Diversion Structure" include wells. <br /> Q: Do the Rules apply to instrearn flow water rights? <br /> A: No. I nstream flow water rights are outside the scope of the Rules because they <br /> are not Diversions, and the Rules apply to Diversions and Other Structures. The <br /> Rules are about the physical measurement and control of water, and the structures <br /> covered by the Rules (primarily Diversion Structures) involve some physical impact <br /> to the natural flow of the stream, which is not the case for instream flow water <br /> rights. DWR retains the authority to require measurement of water rights, <br /> including instream flow water rights, when necessary. DWR's current practice is to <br /> require measurement of instream flow water rights if they call for water. The <br /> Rules don't change the status quo of instream flow water right administration. <br /> Q: What are the requirements for my small augmentation pond? <br /> A: Augmentation ponds are subject to the requirements of the Rules. If the pond is <br /> not located on a natural stream (see Rule 4.1.13 for the definition of Off-Stream <br /> Reservoir), Rule 6.1.9 for Off-Stream Reservoirs applies. Under that Rule, the <br /> augmentation pond must be equipped with two of the following, as further <br /> described in that Rule: measurement at the point of Diversion for the structure <br /> used to deliver water to the pond, measurement of the volume of water in <br /> storage, or measurement of releases. Measurement of releases is therefore not <br /> required for every augmentation pond. Also, if the measurement of the volume of <br /> water in storage (Rule 6.1.9.2) can be used to calculate the change in storage <br /> volume (which vAll usually be the case), that measurement is also sufficient to <br /> measure Diversions to the pond under Rule 6.1.9.1 and releases from the pond <br /> under Rule 6.1.9.3, as long as deliveries to and releases from the pond are not <br /> being made at the same time.
