ADMINISTRATION GUIDELINE <br />Access to Private Property <br />Division One — South Platte River <br />This guideline addresses accessing private property by duly authorized staff of the division <br />engineer. Division engineer staff has both the authority and duty to access private property for <br />the purpose of water administration. Specifically, § 37-92-502(6), C.R.S. states: <br />"The state engineer and the division engineers and their duly authorized <br />assistants and staff have the authority and duty to enter upon, and to order any <br />person to permit the entry upon, private property at any reasonable time to <br />inspect the various means or proposed means of diversion, transportation, and <br />storage and the uses to which water is being, or is proposed to be, put and to <br />read meters, gauges, and other measuring devices. " (underline emphasis added) <br />Division engineer staff are directed to avoid damaging property and to make every effort to <br />respect personal property. For the purposes of this guideline, "access to private property" <br />means: <br />1. entering unenclosed spaces such as fields, farm roads, etc.; and, <br />2. entry to enclosed spaces limited to pump, well, meter, gauge or recorder enclosures <br />provided such entry may be made without accessing a private residence. <br />Under no circumstances is division engineer staff authorized to enter a private residence without <br />the express consent and in the company of the owner or resident and then only for the purposes <br />of performing the duties of their job that simply cannot be accomplished without entering the <br />residence. <br />Administration Guideline — Access to Private Property <br />Revised December 1, 2007 <br />
