STATEMENT OF BASIS AND PURPOSE FOR THE <br /> ADOPTION OF STATEWIDE NONTRIBUTARY GROUND WATER RULES <br /> I. STATEMENT OF BASIS WITH SPECIFIC STATUTORY AUTHORITY: <br /> The Rules and Regulations Applying To Well Permits To Withdraw Ground <br /> Water Pursuant To Section 37-90-137(4) , C.R.S. ("Statewide Nontributary <br /> Ground Water Rules") are proposed pursuant to the authority granted the <br /> State Engineer in Sections 37-90-137(9) (a) and 37-80-102(l ) (9) , C.R.S. <br /> In Section 37-90-137(9) (a) , C.R.S. , the General Assembly authorized the <br /> State Engineer to adopt rules to prescribe reasonable criteria and <br /> procedures for the application for, and the evaluation, issuance, <br /> extension, and administration of, well permits applied for pursuant to <br /> Section 37-90-137(4), C.R.S. <br /> Section 37-80-102(l ) (g) , C.R.S. grants the State Engineer the executive <br /> responsibility and authority with respect to rulemaking for the Division <br /> of Water Resources. <br /> The above two citations are 'the specific statutory citations that the <br /> State Engineer--r-e-l-ies---up o-rt -.i-,n—a-d-o-p-ti-ng---t-4es-e-rules, <br /> Since the original adoption of Section 37-90-137(4) , C.R.S. (Senate Bill <br /> 213) by the 54th General Assembly in 1973, the State Engineer has <br /> conoucted numerous hydrologic analyses, the results of which factually <br /> support the promulgation and the content of these rules. These rules do <br /> not apply to any particular aquifer or portion thereof. Rather, they are <br /> statewide in scope and procedural in nature® They co not identify aquifer <br /> characteristics or tributary or nont-rioutary aquifers or portions thereof. <br /> 11. STATEMENT OF PURPOSE: <br /> The General Assembly authorized the State Engineer to adopt rules pursuant <br /> to Section 37-90-1370)(a), C.R.S. for the purpose of making the State <br /> Engineer's consideration of well permit applications for the withdrawal of <br />
