<br />The terms and conditions set forth in this Joint Conference Report as either “agreed to” or “unresolved” are based on the parties’ current understanding of the Pilot Project and information <br /> presented to date. All of these terms and conditions are the subject of negotiation and compromise and shall not be relied on as establishing any precedent in any other proceeding. <br /> In submitting this Joint Conference Report, no party is waiving its right to challenge on appeal any approval of the Pilot Project, in whole or in part, or to litigate or provide evidence <br /> or expert testimony on any issue as a part of any water court appeal taken from any CWCB or State Engineer’s Office approval of the Pilot Project, subject to the right of other parties <br /> to object to such testimony or evidence.
