Should the Board select the Applicants’ <br />proposal for further consideration, however, the Board should only consider approving the pilot <br />project upon review and full vetting of a subsequent, well-developed pilot project application <br />that includes detailed information regarding how the proposed pilot project can operate without <br />injury to vested water rights, including without limitation proposed terms and conditions to <br />ensure proper measurement, accounting and reporting, verification of fallowing, and <br />maintenance of historical return flow patterns. Additionally, any use of shares in the subject <br />ditch companies should be subject to approval under all applicable bylaws and rules and <br />regulations of those companies, taking into account the protection of the rights of other <br />shareholders. Colorado Beef reserves all rights to comment upon, and oppose if necessary, the <br />Applicants’ pilot project application if and when it is submitted. <br /> <br />Colorado Beef respectfully requests that it be included on any list of interested parties <br />developed by Applicants or the Board and copied on any future correspondence regarding <br />Applicants’ proposal.
