Colorado Springs Utilities Pilot Project Proposal <br />November 16, 2018 <br />Page 4 <br /> <br />intermittently fallowing all or portions of their farms for three years during the ten-year term of this <br />pilot project to meet CS-U’s needs. <br />Catlin Canal Company. Pursuant to a resolution signed by the Catlin board, Catlin will provide <br />up to 5,000 acre-feet of water for lease to CS-U during the ten-year term of the CS-U Pilot Project. <br />Resolution of the Board of Directors of the Catlin Canal Company, dated November 13, 2018 (“Catlin <br />Resolution”), attached as Exhibit B. Catlin will present a contract between Catlin and Super Ditch for <br />shareholder approval at the shareholder meeting in December. Upon approval, Catlin will execute the <br />contract with Super Ditch, and will then enter into contracts with individual shareholders. Catlin will <br />select historically irrigated parcels to be fallowed when CS-U requests lease water during the ten-year <br />term of the CS-U Pilot Project. Information regarding the historically irrigated lands and associated <br />shares used in irrigating the interested shareholders’ land is provided in the attached Table 1. <br />Additionally, a map showing the interested shareholders’ historically irrigated lands is attached as <br />Exhibit C. <br />Fort Lyon Canal Company. Pursuant to a letter of intent signed by the Fort Lyon board, Fort <br />Lyon will provide up to 5,000 acre-feet of water for lease to CS-U during the ten-year term of the CS-U <br />Pilot Project. Fort Lyon Letter of Intent, dated November 14, 2018 attached as Exhibit D. Fort Lyon <br />will present a contract between Fort Lyon and Super Ditch for shareholder approval at the shareholder <br />meeting in December. Upon approval, Fort Lyon will execute the contract with Super Ditch, and will <br />then enter into contracts with individual shareholders. Similar to Catlin, Fort Lyon will select <br />historically irrigated parcels to be fallowed when CS-U requests lease water during the ten-year term of <br />the CS-U Pilot Project. Information regarding the historically irrigated lands under Fort Lyon and <br />associated shares used in irrigating these lands is provided in the attached Table 1. Additionally, a map <br />showing Fort Lyon’s historically irrigated lands is attached as Exhibit E. <br />Rocky Ford High Line Canal Company. Pursuant to a letter of intent signed by the High Line <br />board, High Line will provide up to 5,000 acre-feet of water for lease to CS-U during the ten-year term <br />of the CS-U Pilot Project. High Line Letter of Intent, dated November 16, 2018 attached as Exhibit F. <br />High Line will present a contract between High Line and Super Ditch for shareholder approval at the <br />shareholder meeting in December. Upon approval, High Line will execute the contract with Super <br />Ditch, and will then enter into contracts with individual shareholders. Similar to the other canal <br />companies, High Line will select historically irrigated parcels to be fallowed when CS-U requests lease <br />water during the ten-year term of the CS-U Pilot Project. Information regarding the historically <br />irrigated lands under High Line and associated shares used in irrigating these lands is provided in the <br />attached Table 1. High Line’s historically irrigated lands are shown on the overall map attached as <br />Exhibit G. <br />D. The Water Rights to be Used <br />The water rights to be utilized in the CS-U Pilot Project are those owned by Catlin, Fort Lyon, <br />and High Line and delivered to the Participating Farmers.
