Ms.Megan Gutwein <br /> August 16,2019 <br /> Page 22 of 25 <br /> 15.Exchange into Pueblo Reservoir may occur only when there is at least 100 cfs of <br /> outflow (inclusive of hatchery flows) from Pueblo Reservoir. Such <br /> diversions/exchanges may not cause the outflow from Pueblo Reservoir to be less <br /> than 100 cfs. In addition, exchanges will be operated as junior to the City of Pueblo's <br /> recreational in-channel diversion water right awarded in Case No. 01CW160, and as <br /> though the right is in effect 24 hours per day. <br /> 16.Any exchange of water as a part of this Pilot Project not operated pursuant to a court <br /> decree must be approved in advance by the Division Engineer after a determination <br /> that there is sufficient exchange potential to accomplish the requested exchange <br /> without injury to other water rights. <br /> 17.Exchanges completed via the decree for Case No, 10CW04 will comply with all terms <br /> and conditions decreed therein. <br /> 18.Applicants may operate an exchange only if there is a live stream between the <br /> downstream exchange-from point and the upstream exchange-to point. <br /> 19.Stored water derived from the Colorado Springs/Super Ditch Pilot Project and/or fully <br /> consumable sources available to Colorado Springs will be used to meet the lagged <br /> historical return flow obligations associated with the fallowing of the historically irrigated <br /> lands.Transit losses as assessed by Division 2 will be included from the point of release <br /> to the confluence of the Arkansas River and Crooked Arroyo. Lagged historical return <br /> flow releases will generally be made from Lake Meredith but may also be made from <br /> Pueblo Reservoir, or by utilizing Colorado Springs'fully reusable return flows available at <br /> the mouth of Fountain Creek. <br /> 20.Any return flows not met by proper delivery of that portion of the available headgate <br /> diversions shall be made up from some other source decreed for this use or approved <br /> for this use by a substitute water supply plan. Absent prior approval by the Division <br /> Engineer of some other source, it will be assumed those losses will be made up from <br /> the consumptive yield of shares included in the Pilot Project and Colorado Springs' <br /> replacement sources. <br /> 21.AII diversions shall be measured in a manner acceptable to the Division Engineer. <br /> Super Ditch shall install and maintain measuring devices as required by the Division <br /> Engineer for operation of the Pilot Project. <br /> 22.Accounting of water in this Colorado Springs/Super Ditch Pilot Project must be <br /> provided to the Division Engineer on forms and at times acceptable to him. Said <br /> accounting must be received by the 10th of the month following the month being <br /> reported. The name, mailing address and phone number of the contact person who is <br /> responsible for operation and accounting of this plan must be provided on the <br /> accounting forms. <br /> Martin and Wood Water Consultants,Inc. <br />
