<br />Enforcement Items and Actions
<br />Enforcement actions performed by staff this quarter are summarized below:

<br />NORTHERN HIGH PLAINS
<br />Marks Butte GWMD
<br />-Mark Reifenrath was identified as using an irrigation well to irrigate illegally expanded acres. A show cause has been sent to Mr. Reifenrath, but we have not yet received a response.
<br /> Staff is proceeding with enforcement actions.
<br />

<br />Arikarre GWMD
<br />-At the request of the GWMD, Staff reviewed C. L. Karks irrigation operation and verified that Mr. Karks is operating his irrigation wells in compliance with the permits. There is no
<br /> violation at this time.
<br />
<br />-Charles and Lois Schulte were identified as using irrigation wells to irrigate illegally expanded acres. A show cause has been sent to Mr. and Mrs. Schulte, and we are awaiting their
<br /> response.
<br />
<br />KIOWA BIJOU
<br />North Kiowa Bijou GWMD
<br />-Wayne Mitchell was identified as using his irrigation well for unpermitted commercial purposes. Mr. Mitchell is currently applying to change the use of his permit.
<br />
<br />Miscellaneous
<br />
<br />On July 2, 2008 the Hearing Officer conducted a hearing for adoption of the State Engineer’s Rules and Regulations Governing the Measurement of Ground Water Diversions Located in the
<br /> Republican River Basin Within Water Division No. 1. The rules were adopted and will become effective on December 1, 2008.
<br />
<br />Staff has spent considerable time and effort working on policies and forms implementing the new Republican River Measurement Rules. Power Conversion Coefficient and flow meter test
<br /> report forms are now being submitted, and review of those forms is beginning.
<br />
<br />Three positions for a new Republican River well measurement enforcement team have been exempted from the current state hiring freeze, and the process of testing for the lead engineer
<br /> for that team is in progress.
<br />
<br />On August 4-7, 2008 the Hearing Officer held a hearing concerning the petitions by Mr. Richard Uhrick and Mr. Craig Kroskob to alter and expand the boundaries of the Kiowa-Bijou Designated
<br /> Ground Water Basin. On November 4, 2008 the Findings of Fact, Conclusions of Law, and Initial Decision of the Hearing Officer was issued denying the petitions.
<br />
<br />An agreement has been reached in Pioneer Irrigation District’s request to de-designate portions of the Northern High Plains Basin, allowing the hearing originally scheduled in June 2008
<br /> to be postponed to January 26, - February 6, 2009. The hearing is expected to be vacated following the recent approval of the bond issue in Yuma County.
<br />
<br />Following a publication and interview process, the open engineering position (Sarah Reinsel’s position) on the Designated Basin’s team was offered to two applicants, both of whom declining
<br /> the offer. The current state hiring freeze has put a stop to re-advertising and filling that position.
<br />
<br />Staff has continued to spend time performing field inspections for large capacity change of well location applications, enforcement of permits, and for wells in the final permit process.
