Like the Commission and the State <br /> Engineer, the districts may to pursue enforcement in District Court and collect attorneys fees in successful actions. <br />The new law describes the process for the District to provide notice of an order. <br />Changes to C.R.S. § 37-90-111.5 <br />The law adds Districts to the specific statutes that already give the Commission and the State Engineer enforcement authority. Specifically, districts may now: < <br />enforce an order of a District, in district court if necessary <br />assess fines, not to exceed $500 for each violation, for failure to comply with district rules requiring submission of data on amounts of water pumped, for false or fictitious reports <br /> on amounts of water pumped, falsification of any data as to amounts pumped, false or fictitious reports of power coefficients, or falsification of any power coefficient test. <br />collect and retain fines for violations of a District order or rule <br />collect from Violators of District orders or rules, all expenses incurred by the State in remedying the resulting violation of an interstate compact. <br />The law directs that the Commission, the State Engineer, and a District “… coordinate enforcement actions to ensure that multiple actions are not filed with regard to the same violation <br /> or failure to comply.” <br />Proposed method of coordination of enforcement action between the Commission and the Districts <br />Prior to either the Commission or State Engineer or a District issuing any order, the party proposing to issue the order should convey its intent to issue an order to the other party. <br /> Should both parties intend to issue an order regarding the same violation, the Commission and State Engineer and the District shall consult to determine which one will issue an order. <br />When a violation occurs where the Commission or State Engineer and a District could issue an order, the generally expected practice would be that the District would issue orders for <br /> an occurrence that is a violation of the District’s rule only, but not a violation of the Commission’s rule. As a rule, the Commission would issue orders for violations of well permits <br /> and rules of the Commission and State Engineer.
