He noted that a farmer’s livelihood is his water and that he does not like the wording of commercial. Commissioner Tietmeyer stated that agriculture is only allowed to <br /> sell consumptive use water. He then moved to refer the matter to the Hearing Officer. Commissioner Smith seconded the motion which passed unanimously. b. Application of Front Range <br /> Resources for a replacement plan, case no. 13-GW-07. Mr. John Buchanan, representing Front Range Resources addressed the Commission. He provided the Commission with a brief history <br /> of the matter, noting that the application was originally filed in 2008, published in 2013, that the Hearing Officer had granted a motion disallowing certain replacement sources and <br /> his clients’ rebuttal expert witness report. Mr. Buchanan said that the proposal before the Commission came about after extensive discussion between all parties and is the equivalent <br /> of a stipulation. He requested that they approve the Hearing Officers order dismissing the plan so that it can go directly to court and save many thousands of dollars for all parties. <br /> Chairwoman Burr explained the effects of a De Novo review on this matter to the Commission. She said that though she is generally opposed to this type of thing, she thinks that they <br /> should approve the request and allow it to proceed directly to the courts. Commissioner Arnusch asked if this had happened in the past and was told it had not. Commissioner Sullivan <br /> said that this action would allow the parties to skip a couple of weeks at trial for what all parties agree will go to court anyway. He said that a lot of money had already been spent <br /> and that this action will save all parties considerable sums. Commissioner Smith moved to affirm the Hearing Officers decision. Commissioner Schubert seconded the motion which passed <br /> with one nay. Chairwoman Burr called for agenda item no. 12, public comment. Mr. Andy McClary, attorney for North Kiowa-Bijou GWMD, addressed the Commission. He expressed the District’s <br /> concern over the handling of the Rocky Mountain Roosters violations along Kiowa Creek. He asked for regular updates on the enforcement action requesting that staff move more forcefully. <br /> Mr. Keith Vander Horst informed the Commission that he has been in contact with Rocky Mountain Roosters and that they had submitted an application which he has returned to them. Mr. <br /> Vander Horst indicated that staff was handling this matter following guidelines approved by Ground Water Commission Meeting Minutes Page 7 February 20, 2015 the Commission on working <br /> with the user’s. Mr. Vander Horst closed his comments stating that if the application was not resubmitted by Tuesday he would contact the applicant. Mr. Robert Longenbaugh approached <br /> the Commission. He reminded the Commission of his activities in the South Platte Round Table. He noted that the process is in high gear and that they should contribute comments to <br /> the work product and encourage other users (farmers and towns) to do so. Mr. Longenbaugh mentioned three proposals already in the plan: use of Kiowa-Bijou Basin as a storage reservoir, <br /> importing water from the Missouri River and cloud seeding, noting that last two ideas were also proposed in the 1970’s. Mr. Dennis Coryell approached the Commission. He said that <br /> the Commission should consider asking the Governor to reconsider term limits on its members. He also cautioned the State Engineer and staff to be very careful when amending the Republican <br /> River Well Measurement Rules noting that creating differences between Districts can be make it hard when the East Cheyenne and Plains Districts share a manager. There being no further <br /> business the meeting adjourned. Permit activities are summarized as follows. <br />Small capacity: <br />106 small-capacity new and replacement well permit applications were received <br />95 small-capacity new and replacement well permits were issued <br />Large Capacity: <br />77 large-capacity new and replacement well permit applications, and Determination of Water Right applications, were received <br />54 large-capacity new and replacement well permits and Determinations of Water Rights were issued <br />5 large-capacity well permits were canceled <br />Table 2 provides details on the individual pending large-capacity new and replacement permit applications and Determination of Water Right applications. <br />Change Applications <br />Table 1 also gives a breakdown, by basin, of change of water right application activities for the last quarter: <br />20 new change applications were received <br />8 change applications were approved <br />Table 3 provides details on the individual pending change of water right applications. <br />Final Permit Activities <br />Below is a summary of the status of permits subject to Final Permitting as of April 30, 2015. A show cause letter was sent to Mr. Richards on February 17th and he responded <br /> with information indicating that the well was not operating in violation. Mr. Richards signed and returned the Well Permit Compliance Notice. Staff will be performing a field inspection <br /> this May to verify compliance. <br />An Arikaree GWMD board member reported that Roger Richards was irrigating illegally expanded acres. A show cause letter was sent to Mr. Richards on February 17th. Following this show <br /> cause letter, the GWMD manager provided us with additional information which verified the well was not operating in violation. <br />LOST CREEK <br />Lost Creek GWMD <br />It was reported that Todd Denning has been irrigating illegally expanded acres for the last 30 years. A show cause letter was sent to the owner on May 6th. Staff is currently working <br /> with Mr. Denning to address the violation. <br />UPPER BLACK SQUIRREL CREEK <br />Upper Black Squirrel Creek GWMD <br />A letter was sent to Meridian Service Metropolitan District requiring them to submit an application for a replacement plan to address diversions and depletions from its under-drains. <br />A letter was sent to Woodmen Hills Metropolitan District requiring them to re-submit their applications for well permits and a replacement plan to address diversions and depletions from <br /> its under-drains. <br />Miscellaneous <br />Staff continues working on amending the Republican River Basin Well Measurement Rules.
