<br /> letter informing you that well permits nos. 35423-FP and 37055-FP may not be used for supplying oil well drilling and wind farm development. In our meeting you asserted that the allowed
<br /> use of these wells should include the sale of water for purposes such as oil & gas well drilling and construction operations, and a wide variety of other unidentified commercial uses,
<br /> based on your claim that such uses were intended when the permits were issued. After additional review the State Engineer has determined that the sale of water, or other unidentified
<br /> commercial uses, is not a permitted use of these wells. Well permit no. 145486 was issued with a condition of approval stating the well may be " ... used in one commercial business
<br /> described as a piscatorial farm". Based on this condition well permit no. 145486 may not be used for the sale of water, or other uses. It is this office's opinion that the use intended
<br /> under the commercial reference in conditional permit nos. 35423-FP and 37055-FP was sp-ecifically that of raising, processing, and sale of fish. It was not the practice of the Ground
<br /> Water Commission to issue permits for a wide variety of unidentified commercial uses. While you assert that sale of water from one or more of the wells occurred circa 1970's prior to
<br /> issuance of the subject permits, and the intent for such future uses was in your minds when the applications were filed, there is no evidence in the files that such use; or any other
<br /> commercial uses, were intended when the permits were issued in 1989 and 1990. In addition, the files show no other types of commercial use were perfected within the three years after
<br /> the conditional permits were issued, and so the commercial use on the Final Permit includes only the perfected uses of raising, processing, and sale of fish. Be advised that the use

<br /> the wells with permit nos. 35423-FP, 37055-FP, and 156486. Our office will be performing field inspections of these wells in the coming weeks, and we will be reading the wells' totalizing
<br /> flow meters. If we discover that any of the wells are being used for any unpermitted uses, we will pursue additional legal action which will include cease arid desist orders that carry
<br /> fines of up to five hundred dollars per day for each day said order is violated. If you wish to use any of these wells for uses other than described above, such as domestic or stock
<br /> watering, you would have to apply to re-permit the well for such use. A new small capacity well permit may be available for one or more of the wells, but issuance of such a permit would
