Use of Wells with Permit Nos. 35423-FP, 37055-FP, and 156486 Dear Messrs. Beedy: ocr 1 6 2014 I am writing to follow up on your meeting with State Engineer Dick Wolfe and his staff
on September 22, 2014 in which we discussed the permitted uses associated with the wells with permit nos. 35423-FP, 37055-FP, and 156486. This meeting was a result of my April 22, 2014
letter informing you that well permits nos. 35423-FP and 37055-FP may not be used for supplying oil well drilling and wind farm development. In our meeting you asserted that the allowed
use of these wells should include the sale of water for purposes such as oil & gas well drilling and construction operations, and a wide variety of other unidentified commercial uses,
based on your claim that such uses were intended when the permits were issued. After additional review the State Engineer has determined that the sale of water, or other unidentified
commercial uses, is not a permitted use of these wells. Well permit no. 145486 was issued with a condition of approval stating the well may be " ... used in one commercial business
described as a piscatorial farm". Based on this condition well permit no. 145486 may not be used for the sale of water, or other uses. It is this office's opinion that the use intended
under the commercial reference in conditional permit nos. 35423-FP and 37055-FP was sp-ecifically that of raising, processing, and sale of fish. It was not the practice of the Ground
Water Commission to issue permits for a wide variety of unidentified commercial uses. While you assert that sale of water from one or more of the wells occurred circa 1970's prior to
issuance of the subject permits, and the intent for such future uses was in your minds when the applications were filed, there is no evidence in the files that such use; or any other
commercial uses, were intended when the permits were issued in 1989 and 1990. In addition, the files show no other types of commercial use were perfected within the three years after
the conditional permits were issued, and so the commercial use on the Final Permit includes only the perfected uses of raising, processing, and sale of fish. Be advised that the use
of wells with permit nos. 35423-FP, 37055-FP, and 156486 must be limited as described below: 35423-FP- The well may divert up to 180 acre-feet annually for the raising, processing,
and sale of fish, and the irrigation of 40 acres in the East � of the East � of Section 18, Township 7 South, Range 53 West, of the 61h PM. 1313 Sherman Street, Room 821. Denver, CO

and sale of fish, and the irrigation of 90 acres in the East � of the East � of Section 18, Township 7 South, Range 53 West, of the 6th PM. 156486- The well may divert up to 80 acre-feet
annually for a piscatorial farm (i.e. the raising, processing, and sale of fish). You must immediately cease all unpermitted uses, specifically including the sale of any water, from
the wells with permit nos. 35423-FP, 37055-FP, and 156486. Our office will be performing field inspections of these wells in the coming weeks, and we will be reading the wells' totalizing
flow meters. If we discover that any of the wells are being used for any unpermitted uses, we will pursue additional legal action which will include cease arid desist orders that carry
fines of up to five hundred dollars per day for each day said order is violated. If you wish to use any of these wells for uses other than described above, such as domestic or stock
watering, you would have to apply to re-permit the well for such use. A new small capacity well permit may be available for one or more of the wells, but issuance of such a permit would

Midwest Farms was discovered to have pumped four large capacity wells in excess of their individually permitted 2014 acre-foot allocations. In 2015, the wells will be under order for
overpumping and diversions from the wells shall be limited to amounts being equal to what would otherwise be the permitted withdrawals for the 2015 water year minus the amounts the
wells overpumped in 2014.

are waiting for their response.

Lost Creek GWMD
PV LLC pumped a large capacity well in excess of the annual allocation approved in the well’s change of use authorization. A letter was send to the owner informing them that we would
be carefully monitoring the well’s pumping during the 2015 water year.

Svc Dist. Case No. 08-GW-71 Designated Basin: Upper Black Squirrel Date of request: Oct. 15, 2008 Subject: Objection to an application for approval of a replacement plan
to make new appropriations from the alluvial aquifer within the Upper Black Squirrel Creek Designated Basin. Status: Two weeks of hearing held June 8th thru June 19, 2009. Case consolidated
with Case Nos. 08GW78 as well as the change case filings for well nos. 9 through 12 (09GW15). Case is presently stayed pending outcome of district court declaratory judgment proceedings
on stipulation interpretation. Supreme Court issued a decision in December on the 2 ability of Meridian to Intervene in the declaratory action regarding the stipulation in 98CW80
and indicated Meridian could intervene and remanded to water court for further action. All cases related to the replacement plan are stayed pending the outcome of a determination concerning
interpretation of the stipulation as it relates to use and reuse within the basin. Action still pending determination by District Court as to whether Order entered by Court is presently
appealable. Relevant cases before Commission therefore remain stayed. Oral argument before Supreme Court held on December 10, 2014. Their decision is pending. Cherokee Metropolitan
