Enforcement Items and Actions

Enforcement actions consisted of complaints concerning small capacity well permits or lack thereof, and large capacity wells being used for un-permitted uses. Staff has also resolved
some enforcement actions addressed at the previous Commission meeting.

In the Upper Black Squirrel Designated Basin we received a complaint regarding irrigation wells owned by CCVF LLC. The complaint stated that the wells had been illegally constructed
in un-permitted aquifers, and the owners were unable to match the wells with their respective permits. Staff performed a field inspection and found the wells to be constructed within
the permitted aquifers, and we are currently working with CCVF to ensure that the wells are properly marked in an attempt to avoid any further confusion. Staff has resolved the enforcement
action regarding the small capacity well being used to supply water to five homes on one lot in the Town of Peyton. The owner is now in compliance with her permit.

In the Kiowa Bijou Designated Basin staff has resolved the enforcement action regarding two hand-dug livestock wells in the Kiowa-Bijou Designated Basin near Strasburg. An inspection
has revealed that the owners have backfilled the excavated holes and the matter is now resolved.

In the Camp Creek Designated Basin we received a complaint stating that large capacity wells were being used for a highway construction project and a feedlot without applying for or
receiving an approved change of use. After further review of the final permit Staff has determined that the wells are permitted for both uses in question. A second complaint was
received regarding a small capacity stock well being used for a highway construction project. Staff has contacted the owner of this well, and the matter has been resolved.

In the Southern High Plains Designated Basin we received a complaint that a large capacity well permitted only for irrigation was being used in a feedlot operation. After further review
of the permit files and speaking with the owner, staff has determined that the well is currently permitted for both uses.

Finally, with the help of Stan Murphy, the staff is close to resolving an ongoing complaint regarding the illegal use of a stock well by Kenneth Pottorff in the Plains Ground Water
Management.

Miscellaneous

Staff spent time this quarter participating in other duties, of which are presented below:

Staff has attended various water quality meetings with the Water Quality Control Commission.
Staff attended the Republican River Ground Water Modeling Committee meetings.
Staff participated in DNR’s efficiency study entitled the Core Mission Project.
Suzanne Sellers was promoted to the Team Leader of the Designated Basins Branch.

Memorandum to Hal Simpson Page 2
Quarterly Commission Staff Activity Report
November 12, 2003

S:\DesBasPrograms\GWC Meetings\Nov 2003\StaffReportNov03.doc

EARNEST L.
