Enforcement Items and Actions <br /> <br />Enforcement actions this quarter consisted of a complaint concerning an illegally commingled well operation, owned by Gary Alexander, being used for un-permitted commercial uses in the <br /> Kiowa Bijou Designated Basin. <br /> <br />As of November 9, 2004, Mr. Alexander had severed the illegally commingled lines, and he claims the wells are now being used solely for their permitted uses. Staff has scheduled a field <br /> inspection for November 17, 2004 to verify this. <br /> <br />Earlier this year, Staff responded to complaints by two separate well owners in the Upper Crow Creek Designated Basin claiming that they believe the well owned by Reinaldo Gallegos ETAL <br /> is completed in the alluvium of Crow Creek rather than the aquifer (White River) that was permitted. This summer, the staff of the Board of Examiners visited the site and confirmed <br /> that the well was in fact illegally completed. Mr. Gallegos has since abandoned the well. However, Mr. Gallegos’ attorney still has an appeal of staff’s action before the Hearing <br /> Officer. <br /> <br /> Miscellaneous <br /> <br />We are please to announce that Chris Grimes will be transferring back to the team as an EPS Tech I. He will be acting as the Designated Basin Water Commissioner and assisting in the <br /> issuance of final permits. <br /> <br />We are also pleased to welcome Jay Bloomfield as our new EPS Assistant II.
