<br />Enforcement Items and Actions <br />Enforcement actions performed by staff this quarter are summarized below <br /> <br />NORTHERN HIGH PLAINS <br />Central Yuma <br />Jerry Brandt was found to be using an irrigation well for livestock purposes only. A show cause letter was sent out on October 31st and we are awaiting Mr. Brandt’s response. If Mr. <br /> Brandt ceases the illegal use and returns to irrigation as permitted, he will be required to equip the well with a water measurement device. <br /> <br />UPPER BLACK SQUIRREL CREEK <br />Upper Black Squirrel Creek GWMD <br />On September 1, 2011 a cease and desist order was posted on a well operated by Dean Goss. Field inspections performed September 6th – 9th verified that Mr. Goss had ceased the well’s <br /> use and severed the line to the sprinkler. At this time the irrigation well is in compliance with the permit. Another field inspection will be performed in the spring to verify continued <br /> compliance. <br /> <br /> <br />Last quarter Staff responded to a complaint involving the unpermitted commingling of two irrigation wells owned by Mr. George Schubert. A show cause letter was sent to Mr. Schubert which <br /> he promptly responded to, ceasing use of the two wells. Mr. Schubert has signed a Well Permit Compliance Notice agreeing to cease unauthorized use of the two wells. A field inspection <br /> was performed which verified the wells were in compliance with the well permits and notice. Another field inspection will be performed in the spring to verify continued compliance. <br />Staff has since received a second complaint from Mr. Dean Goss requesting that we inspect all wells located on the Schubert property, within six sections of land, based on his information <br /> and belief that Mr. Schubert is drilling unpermitted wells. Staff responded to Mr. Goss by requesting more specifics, including the source of the information, and the number and location <br /> of the illegal wells. Upon receiving additional specifics Staff will pursue the complaint. <br /> <br />Last quarter Staff responded to a complaint that Mr. Wayne Booker was using one well that had been ordered to be plugged and abandoned, and was using two other wells to irrigate unpermitted <br /> lands. Mr. Booker replied that the one well does not exist, and the other two wells are authorized to be used on the lands irrigated. Staff has requested that Mr. Dean Goss verify <br /> the claimed location of the site of the one well which was to have been plugged and abandoned upon which it will field inspect that well site. Staff has told Mr. Booker that the other <br /> two wells are not authorized to be used on the land on which he claims they may be used. While Mr. Booker claims those two wells are currently shut down, a field inspection will be <br /> performed in the spring to verify they are not being used in violation of their permits. <br />Staff has since received another complaint from Mr. Dean Goss claiming that based on his information and belief Mr. Booker is re-drilling wells without capping the replaced well and <br /> then pumping both wells. Mr. Goss requests that Staff field inspect any and all of Mr. Booker’s well on properties within four sections. Staff responded to Mr. Goss by requesting <br /> more specific information, including the source of the information and which wells were replaced and not plugged. Upon receiving additional specifics Staff will pursue the complaint. <br /> <br />KIOWA BIJOU <br />Staff investigated wells owned by L & M Ranch to verify compliance with irrigation well permits and a replacement plan. A report received by our office indicated that a pond on the <br /> property had exceeded the size and area allowed under the replacement plan.
