Enforcement Items and Actions

Enforcement actions performed by staff this quarter are summarized below:

Upper Black Squirrel:

A complaint was submitted claiming that Craig Powell was using a small capacity well to fill a pond. Mr. Powell is now in compliance with his domestic well permit.

A field inspection was performed for lands owned by David and Dean Goss. This inspection was performed in response to a compliant claiming the Goss family had illegally commingled wells
and expanded irrigated acres. Staff is currently reviewing the inspection and permit files to determine a course of action.

North Kiowa Bijou:

Staff received a complaint claiming that Rod Maclennan had illegally excavated ponds in the alluvium for use in a highway construction project. A field inspection revealed that while
the ponds do exist, there is not evidence that they were being used in a highway construction project. The ponds are naturally occurring and are not excavations. This matter has been
closed.

Staff investigated excavations at the Bluff Hunting Club. A complaint had stated that ponds had been constructed on the hunting club property to attract wildlife. These “ponds” are
naturally occurring, and are actually located off of Bluff Hunting club lands. This enforcement action has been resolved.

Upper Crow Creek:

Staff responded to complaints concerning the construction of illegal ponds in the Upper Crow Creek. Fred Marrick illegally exposed groundwater for stock purposes. Mr. Marrick has backfilled
the ponds and is now in compliance. Staff is currently working with Bill Fabricius and Tom Trostel to resolve their enforcement actions.

Sandhills:

Staff was notified by the district that Raymond Schulte and Cure Land have been operating wells with faulty meters. A letter has been sent out to both Schulte and Cure. Staff is awaiting
their response.

Miscellaneous

We are pleased to announce that Eric Thoman has been promoted to fill the vacant Physical Scientist Research Scientist I position. Eric will be working on replacement plans and will
continue to work on GIS projects, Determination of Water Rights and subdivision water supply plans.

We are also pleased to announce that Suzanne Sellers has been officially transferred to be the Team Leader of the Denver Basin (outside of Designated Basins) team. However, she will
continue her work with Designated Basins until her replacement has been found and fully trained. Her transition to her new team will be a gradual one.

Staff has been working with the Republican River Water Conservation District on the consultation process for their water conservation program.

Staff has been working on migrating some of our Denver Basin Aquifer permitting information into digital format using GIS.

Staff has spent time performing field inspections for large capacity change of well location applications.

Memorandum to Hal Simpson Page 3
Quarterly Commission Staff Activity Report
November 9, 2005

S:\DesBasPrograms\GWC Meetings\Nov 2005\StaffReportNov05.doc

EARNEST L.
