<br />SUBJECT: Staff Activity Report for August 1, 2001 through October 31, 2001

<br />Various activities performed during the last quarter are briefly described below.
<br />
<br />New and Replacement Applications
<br />
<br />Table 1 provides a breakdown, by basin, of permitting activity for the last quarter. The following permit activities were performed:
<br />
<br />Small capacity:
<br />
<br />277 small-capacity well applications were received
<br />276 small-capacity well permits were issued
<br />
<br />Large Capacity:
<br />
<br />60 large-capacity well or Determination of Water Right applications were received
<br />49 large-capacity well permits or Determination of Water Rights were issued
<br />
<br />Table 2 shows the current status of new and replacement permit applications for the large-capacity wells.
<br />
<br />Change Applications
<br />
<br />Table 3 provides the current status of the change applications. During the last quarter the following
<br />change application activities occurred:
<br />
<br />8 new applications were received;
<br />15 change applications were approved; and
<br />48 applications are currently in different stages of processing, including 7 in initial processing, 1 in publication, and 40 in hearing (including for 39 for Eagle Peak Farms) as shown
<br /> in Table 3.
<br />
<br />
<br />Final Permit Activities
<br />
<br />For this last quarter, there was final permit activity within the Northern High Plains, Upper Crow Creek and Southern High Plains.
<br />
<br />Activity in the Northern High Plains focused on those remaining conditional permits which were previously set aside due to their complexity or lack of cooperation from well owners.
<br /> Specifically for the Northern High Plains, final permit activity continued with conditional permits within Yuma County. The owners of all un-clairfied permits within the remaining
<br /> five groups have been contacted, though there is still the problem of a slow response from some well owners which delays the clarifying process. However, permits within one group have
<br /> been clarified and published, another group of 60 permits have been clarified and are ready for publication, and the group of permits with only expanded acres have been clarified and
<br /> are ready for publication.
<br />
<br />Work on Upper Crow Creek has also begun. The list of wells requiring a final permit has been finalized and conditional permits have issued for those wells without a permit but were
<br /> registered with the CWCB, registered as a map filing, or decreed by the water court. The preliminary evaluation of the approximately 110 permits has started and letters to well owners
<br /> requesting the necessary information to clarify the permits will be sent out soon.
<br />
<br />Finally, preparatory work continues on the Southern High Plains. The list of all wells requiring a final permit close to being finalized. Additionally, the approximately 1300 conditional
<br /> permits have been sorted and physically grouped together, and the preliminary evaluation of the conditional permits within the first group has started. Letters to well owners within
<br /> that first group, requesting the necessary information to clarify the permits will also be sent out soon.
<br />
<br />As indicated in previous reports, there is the problem of lack of current ownership information within many of the permit files, which causes delays in the clarifying process. In order
<br /> to facilitate correspondence with well owners, the staff asks District Managers to encourage land owners to complete and submit change of ownership/address forms to the Commission Staff,
<br /> if they have acquired wells or moved in the last 10 years.
<br />
<br />Objections/Hearings
<br />
<br />Pending hearing cases are listed in the Hearing Officer's report. The Staff took part in pre-hearing conferences or otherwise spent time trying to resolve or otherwise work on the
<br /> hearing cases related to following applicants: Dennis Dunnivan, Fred O. Gibbs/JoAnn Pearson, Linnebur, Lost Creek Land and Cattle, Larry Ride, Doren Shaulis and University of Colorado.
<br /> Of all the above 7 hearings, all 7 are still pending with 4 being objections to Determinations of Water Right applications, two objections to a water well application, and one has
<br /> an objection to changes in water rights.
<br />
<br />Enforcement Items and Actions
<br />
<br />Staff spent some time permitting a non-exempt replacement well drilled with an emergency verbal approval during 1998. Staff also spent time investigating illegal irrigation in the
<br /> Plains and East Cheyenne GWMDs.
<br />
<br />
<br />Miscellaneous
<br />
<br />Staff spent time this quarter participating in other duties, of which are presented below:

<br />Staff has attended various water quality meetings with the Water Quality Control Commission.
<br />Staff continued to gather information and attend meetings concerning the Republican Compact litigation.
