Enforcement Items and Actions <br /> <br />Enforcement actions consisted of complaints concerning small capacity well permits or lack thereof, large capacity wells being used for un-permitted uses, and a commingled operation <br /> not fulfilling administrative requirements. <br /> <br />Upper Black Squirrel Designated Basin: <br />- Staff received a complaint regarding a well permitted for domestic use being used for four homes. Dave Webb, the well owner, has been notified and we are awaiting his response. <br /> <br />Kiowa Bijou Designated Basin: <br />- Staff discovered a domestic well being used for commercial purposes by the Leader Community Center. The owners have been notified and we are in the process of correcting the violation <br /> through application. <br /> <br />- Following up on a violation reported at the February meeting, staff continues to work with the North Kiowa Bijou GWMD to ensure that Harold Shaver remains in compliance with his Commingling <br /> Order. <br /> <br />Northern High Plains Designated Basin: <br />- Staff responded to a complaint filed by the W-Y GWMD stating that Ruben Richardson had expanded his irrigated acres without approval. Staff is currently working with Mr. Richardson <br /> to resolve the matter. <br /> <br />- Staff responded to a complaint filed by the Plains GWMD stating that Allen Schutte had expanded his irrigated acres and commingled his wells without approval. A Cease and Desist <br /> Order was sent to Mr. Schutte, but he has yet to be in full compliance with the Order. We have given Mr. Schutte one last opportunity to sever this line, and the AG’s office has been <br /> notified. Stan Murphy has performed a number of field inspections and has been very helpful in this process. <br /> <br />- Staff responded to a complaint filed by the Plains GWMD stating that Casey Mitchek has failed to enter into an administration contract with the district or other Commission approved <br /> entity for this irrigation year. A certified letter has been sent to Mr. Mitchek and we are awaiting his response. <br /> <br />Upper Crow Creek Designated Basin: <br />- Staff responded to complaints by two separate well owners claiming that they believe the well owned by Reinaldo Gallegos ETAL is completed in the alluvium of Crow Creek rather than <br /> the aquifer (White River) that was permitted. The staff of the Board of Examiners has visited the site and confirms that the well is in fact illegally completed.
