The future average annual <br /> withdrawal from a well under this Rule shall not exceed the average annual legal historic withdrawal by the well and may be less than this amount to ensure no increased depletion of <br /> the aquifer, i.e. to compensate for any reduction in return flows back to the aquifer. Where a change in the season of use will result in an increased ability to withdraw water, conditions <br /> or limitations shall be imposed to prevent the changed season of use from resulting in an increase in the withdrawal of water over what would occur during the original season of use <br /> under present and future aquifer conditions at the original point of withdrawal. <br /> <br /> <br /> <br />Typical Condition Added to Change of Use Findings and Order: <br /> <br />The Commission has determined that the change in season of use, which is a part of this change in use and place of use, will not at this time allow the applicant to have an increased <br /> ability to withdraw water over what would occur during the original season of use under present and future aquifer conditions at the original point of withdraw.
