<br />** It should be noted to the Commission that all of the above objections to new and change applications for Determination of Water Rights have been filed by either the North Kiowa Bijou <br /> GWMD or the Upper Black Squirrel Creek GWMD. No objections have been received for these applications by individual well owners or water right holders. <br /> <br />Enforcement Items and Actions <br /> <br />A cease and desist order was sent to Mr. Kenneth Pottorff in the Plains GWMD for illegal use of two irrigation wells for high way construction purposes. Mr. Pottorff then submitted <br /> an application for a temporary change of use, which the staff approved. Because the temporary change of use may last longer than 90 days, the temporary change will be published in <br /> a local newspaper. <br /> <br />Additionally, two certified letters were sent to Mr. Mark Hornung and Mr. Richard May in Stratton, CO for illegal irrigation of expanded acres and for illegal irrigation of acres not <br /> authorized. Mr. Hornung has already applied to correct his illegal irrigation. No response has been received by Mr. May. Further legal action may be required with respect to Mr. <br /> May. <br /> <br />Staff investigated two small capacity well violations in the Upper Black Squirrel Creek Basin, one with respect to a single well providing water to too many houses and one for a well <br /> operating without a permit. Investigations showed that the complaint about the well providing water to too many houses was unfounded and that the well was within its permit conditions. <br /> However, the staff is still investigating the well without a permit as the well location was not discovered during the original investigation. <br /> <br />Finally, the staff investigated Lost Creek Land and Cattle and whether they are in compliance with the Commission’s Order that administration is required for commingling. Thus far, <br /> staff has received no information about compliance even after initial requests. <br /> <br /> <br />Miscellaneous <br /> <br />Staff spent time this quarter participating in other duties, of which are presented below: <br /> <br />Staff has attended various water quality meetings with the Water Quality Control Commission. <br />Staff continued to gather information and attend meetings concerning the Republican Compact litigation. <br />Staff has received and has reviewed the proposed new rules for the Upper Black Squirrel Creek GWMD. <br />Staff also reviewed and responded to a proposed Memorandum of Understanding (MOU) from Mr. Kim Lawrence. <br />Staff also spent some time organizing the administrative information submitted and collected by the GWMD for changes of water rights. <br />Staff would like to welcome back Eric Thoman to the Designated Basin staff as an evaluator of non-exempt water right applications. His new duties will include the evaluation and issuing <br /> of Determination of Water Rights, non-exempt permits, and change applications within the designated basins.
