<br />May 6, 2008 <br /> <br />To: Colorado Ground Water Commission <br /> <br />From: Commission Staff <br /> <br />RE: May 16, 2008 GWC meeting, Agenda Item 6 <br />Hearing on the request of the USDA-ARS Central Great Plains Research Station for a Variance to Rules 7.4 and 7.5, to allow applications for a change in description of irrigated acres <br /> for three permits (allowing them to irrigate 40 acres anywhere within a 260 acre area) to be evaluated under the standards of a change in description of acres of Rule 7.4 rather than <br /> under the standards of rotational acres of Rule 7.5. <br /> <br /> <br />The USDA-ARS Central Great Plains Research Station has three permits that currently allow the wells to irrigate a total of 40 acres within four specifically identified areas of section <br /> 12, as follows: <br /> <br />Permit # af/yr Acres Description of Acreage <br />7699-FP 5 6 N1/2 of SW1/4 of NE1/4 of SE1/4 <br /> <br />41675-F 100 6 N1/2 of SW1/4 of NE1/4 of SE1/4 <br /> 4 W1/2 of SE1/4 of NE1/4 of NE1/4 <br /> 8 W1/2 of SE1/4 of NE1/4 <br /> 22 E1/2 of NE1/4 of SW1/4 <br /> === ==================== <br /> 40 Total <br /> <br />41676-F 100 same as 41675-F <br /> <br />Permit no. 41675-F was issued for an increase in acres and annual appropriation of the existing well, permit no. 7699-FP. Permit no. 41676-F was issued for construction of a new well. <br /> The use of permit nos. 41675-F and 41676-F was limited to the same acreage, with a combined annual appropriation limitation of 100 af/yr. <br /> <br />The applicant has submitted applications to change the description of the 40 acres which may be irrigated by the three wells to a 260 acre area of section 12, described as the NE1/4, <br /> N1/2 of SE1/4, and E1/2 of the NE1/4 of the SW1/4, with only 40 acres of that actually irrigated in any one year. The 260 acre area totally encompasses the currently permitted areas. <br />
