<br /> <br />Enforcement Items and Actions <br />Enforcement actions performed by staff this quarter are summarized below <br /> <br />This quarter Staff began the process of identifying those wells within the Republican River Basin that have failed to meet the terms and conditions of the Republican River Measurement <br /> Rules. Of the roughly 4,200 wells subject to the Rules, we have identified around 400 wells that have not been equipped with a measurement device or declared inactive. We are performing <br /> field inspections and sending letters to those well owners to ensure compliance. <br /> <br />Northern High Plains <br />Sand Hills GWMD: <br />A field inspection indicates Virginia and Barry Brown have been operating an irrigation well to irrigate illegally expanded acres. Staff has sent a show cause letter to the Browns <br /> and we have yet to receive a response. <br /> <br />Kiowa Bijou <br />Staff investigated a claim that a small capacity well owned by Frank Ehman was being used to supplement a large capacity irrigation well. A field inspection was performed and a violation <br /> was not identified. <br /> <br />North Kiowa Bijou GWMD: <br />Staff continues to work with the Ground Water Management to ensure 6 wells owned by Freund Investments have been plugged and abandoned as required by orders cancelling the permits. <br /> There is some confusion over the location of these wells and if they are the wells identified by the District. Staff has scheduled a field inspection to clear up the matter which the <br /> GWMD has been invited to attend. <br /> <br />Miscellaneous <br /> <br />The Lost Creek – Hay Gulch rulemaking hearing (case no. 09-GW-12). A fact finding hearing before the Hearing Officer is scheduled for 10 days in March 2010. A rulemaking hearing before <br /> the Commission is scheduled for the May 21, 2010 meeting. In addition to the petitioner four parties requested party status. <br />The Lost Creek – Main Stem rulemaking hearing (case no. 09-GW-13). A fact finding hearing before the Hearing Officer is scheduled for 8 days in September 2010. A rulemaking hearing <br /> before the Commission is scheduled for the November 19, 2010 meeting. In addition to the petitioner three parties requested party status. <br />Upper Big Sandy rulemaking hearing (case no. 09-GW-29). This was published by the Secretary of State on January 10, 2010. A fact finding hearing before the Hearing Officer is to be <br /> scheduled. A rulemaking hearing before the Commission is scheduled for the August 20, 2010 meeting. Other than the petitioner no parties requested party status. <br />The petition to create a new Upper Spring Creek Designated Basin (case no. 09-GW-14). A fact finding hearing before the Hearing Officer is scheduled for 4 days in June 2010. A rulemaking <br /> hearing before the Commission will be scheduled after completion of the Fact Finding hearing. In addition to the petitioner 2 parties requested party status. <br />Chris Grimes continues to spent considerable time and effort assisting the new Republican River Well Measurement team and reviewing power conversion coefficient and flow meter test report <br /> forms being submitted by well owners. <br />The Designated Basin’s team continues to have 2 empty positions.
