Enforcement Items and Actions <br /> <br />Enforcement actions consisted of complaints concerning small capacity well permits or lack thereof and large capacity wells being used for un-permitted uses. <br /> <br />Upper Black Squirrel Designated Basin: <br />- Staff received a complaint regarding a well permitted for domestic use being used for irrigation of 2 acres and pond filling. Staff is currently working to resolve the matter. <br /> <br />Kiowa Bijou Designated Basin: <br />- Staff discovered a domestic well being used for commercial purposes by the Leader Community Center. The owners have been notified and we are in the process of correcting the violation <br /> through application. <br /> <br />Plains <br />- Staff worked with the district and the AG’s office to ensure that Mr. Allen Schutte is in full compliance with his Cease and Desist Order. As of July 22, 2004, Mr. Schutte has severed <br /> the illegally commingled line and is now in compliance. Senate Bill 225 has been instrumental in resolving this matter. Mr. Schutte paid fines and attorney fees as part of a settlement <br /> in this matter. <br /> <br />-A complaint filed by the Plains GWMD stating that Casey Mitchek had failed to enter into an administration contract with the district or other Commission approved entity for this irrigation <br /> year has been resolved. Mr. Mitchek has entered into contract with the district. <br /> <br />Upper Crow Creek Designated Basin: <br />- Staff responded to complaints by two separate well owners claiming that they believe the well owned by Reinaldo Gallegos ETAL is completed in the alluvium of Crow Creek rather than <br /> the aquifer (White River) that was permitted. The staff of the Board of Examiners has visited the site and confirms that the well is in fact illegally completed. Mr. Gallegos has since <br /> abandoned the well and the matter is resolved. However, Mr. Gallegos attorney still has an appeal of staff’s action, but we expect this appeal to be withdrawn. <br /> <br /> Miscellaneous <br /> <br />Staff spent time this quarter participating in other duties, of which are presented below: <br /> <br />Staff has attended various water quality meetings with the Water Quality Control Commission. <br />Staff attended the Republican River Committee meetings. <br />Chris Grimes has transferred to a new team and his position is currently vacant. <br />We are pleased to welcome Sarah Reinsel as our new EIT.
