<br />** It should be noted to the Commission that all of the above objections to new and change applications for Determination of Water Rights have been filed by either the North Kiowa Bijou <br /> GWMD or the Upper Black Squirrel Creek GWMD. No objections have been received for these applications by individual well owners or water right holders. <br /> <br />Enforcement Items and Actions <br /> <br />A cease and desist order was sent to Mr. Kenneth Pottorff in the Plains GWMD for illegal use of a small capacity well for irrigation purposes. As a result of the cease and desist order, <br /> Mr. Pottorff disconnected the small capacity well from the irrigation system to the satisfaction of the Plains GWMD and the staff. However, in July, the Plains GWMD noted that Mr. <br /> Pottorff reconnected the said small capacity well and continued the illegal use from the well. The Plains GWMD requested the staff pursue a legal injunction against Mr. Pottorff to <br /> mandate compliance with the cease and desist order. Current staff is working with the Attorney General’s Office in the filing of the complaint against Mr. Pottorff. <br /> <br />The staff continued with its investigation of Lost Creek Land and Cattle and whether they are in compliance with the Commission’s Order that administration is required for commingling. <br /> As of July, Lost Creek Land and Cattle filed the appropriate well tests and power readings required for administration. <br /> <br />Staff spent time investigating a potential expansion in irrigation within the Lost Creek Designated Basin. Staff conducted a field investigation and determined that the well was not <br /> being used outside the terms and conditions on the well permit. <br /> <br />Staff spent time investigating numerous ponds within the Lost Creek Designated Basin. These ponds were claimed to be filled illegally by small capacity wells. Staff contacted each <br /> well owner listed in the complaint and as of July all the ponds ceased being filled by the respective small capacity well permits. <br /> <br />Staff spent time investigating the potential overuse of a small capacity well within the Upper Black Squirrel Creek Designated Basin.
