NOTES <br />1. Little Fountain River is administered by the following <br />criteria: 12 cfs in the Little Fountain is required at <br />the Highway 115 Bridge (at the mouth of the canyon) before <br />the downstream calls are honored, if there is less than <br />12 cfs flow at this point, the downstream calls are <br />determined to be futile. <br />2. Town of Fountain (on the Little Fountain River) uses <br />0.5 cfs from the Womack right and 0.5 from the 4/1/13 <br />right in their plan of augmentation (W- 4396). Four - ninths <br />of the other 4.5 cfs of the Womack right is owned by the <br />U.S. Army (Fort Carson) and one -ninth by the Town of <br />Fountain. <br />3. OWEN & HALL DITCH - of the 17.4 cfs of the original decree <br />for the No. 8 right, the Gates Land Company has trans- <br />ferred 0.425 cfs to a well, the City of Colorado Springs <br />has transferred 2.0 cfs to Ruxton Water and Power, and <br />0.075 cfs was left to the stream. (See W -56 and W -309). <br />The remainder at the headgate, is used by the City of <br />Colorado Springs in a plan of augmentation for wells <br />(See W -4376 dated 7/27/77). <br />4. LISTON & LOVE - In Case W -4077, 1/4 interest in the Liston <br />& Love right was transferred from the north (original) head - <br />gate approximately 2.25 miles downstream to the south head - <br />gate. <br />5. CRABB DITCH - Town of Fountain plans to use 0.25 cfs of <br />No. 6 right and 0.667 of the No. 16 right in a plan of <br />augmentation (Case W- 4396). <br />6. STUBBS & MILLER - 0.915 cfs decz'eed to a Portland Mill <br />still at headgate. <br />7. LAUGHLIN DITCH - Straatmoor Homes plan for augmentation <br />uses 5.616 cfs of #10 and 1.736 cfs of #17 12/31/63 <br />(2/15/82, E -1) original 2.17 cfs to recharge the Widefield <br />Aquifer see Case W -3935 and W -4237. In the same case, the <br />GAINES & LOVE DITCH, priority No. 31, 3/21/71 (2/15/82, <br />E -1), 11.34 cfs, was left in the Fountain River perman- <br />ently. The Gates Land Company changed 1.872 cfs of the <br />Laughlin #10 priority and 0.434 cfs of the Laughlin #17 <br />priority to wells by decree entered on 12/7/71 (Case No. <br />W -309) in connection with Gate's plan for augmentation. <br />8. Alternatives for E1 Paso County Canal: <br />a) No. 2 Harmes 1.58 cfs at E1 Paso Canal to North <br />Slope Conduit at French Creek (Civil Action 37641). <br />b) No. 3 Bley 22.4 cfs at E1 Paso Canal to Main Ruxton <br />Creek (Civil Action 37645). <br />c) No. 12 Sheldon 8.57 cfs at E1 Paso Canal to junction <br />of Lion Creek and Main Ruxton Creek (Civil Action <br />37644). <br />d) No. 19 Anthony, Botts & Chambers 8.82 cfs at E1 Paso <br />County Canal to South Ruxton below Upper South <br />Ruxton Reservoir. <br />10. CHILCOTT DITCH (near Pueblo) - presently no structure to <br />divert water. <br />11. McELROY DITCH - has not been used in a number of years. <br />12. M.W. STEELE - has been transferred to two wells in the <br />vicinity of the old ditch. <br />13. BENESCH DITCH - transferred to wells on the east side of <br />Fountain River approximately west of the OLIN DITCH head - <br />gate. <br />14. BANNISTER DITCH - water right No. 17 was transferred to <br />wells (Case No. W -3307) near the old Bannister -Eder Ditch. <br />15. In a letter dated 8/29/78 from Bob Jesse, Division 2 <br />Engineer, to Bob Ermel, Water Commissioner, District 10, <br />when the "stream is dry between the Pueblo water and <br />Power Return and the Lincoln Ditch headgate above Pinon <br />Bridge the call of downstream seniors will be considered <br />futile on upstream juniors." <br />16. TOOF & HARMAN DITCH - In Case No. W -4185, the Young and <br />Calaway and the Toof & Calaway were transferred to Toof <br />& Harman headgate located just north of the E1 Paso <br />County - Pueblo County boundary. <br />17. DR. ROGERS DITCH - In case No. W -4422 (State Engineer vs. <br />Pinkston) this ditch was closed until a proper diversion <br />structure is constructed. <br />18.
