Water can only <br /> be diverted into the tunnel when the flow in the Fryingpan River near Thomasville <br /> gage is above a specified minimum flow. <br /> On Friday, August 15, 2025, the Commission held its third quarterly meeting at the <br /> Colorado Mountain College, 901 US-24, Leadville, CO 80461 <br /> Chairman Arnusch and Commissioner Noble were unable to attend the meeting, so <br /> Commissioner Pautler was tasked with calling the meeting to order at 7:30 A.M. <br /> Secretary Matz called the roll and determined that a quorum was present. <br /> Commission members present were Todd Denning, Miguel Diaz, Tim Pautler, Dave <br /> Payne, Tim Hume, Dave Keeler, Clay Kinnison, Jason Ullmann, Nate Pearson (on <br /> behalf of Dan Gibbs), and Emily Zmak (on behalf of Lauren Ris). Staff members <br /> present were Sarah Brucker, Chris Grimes, Mike Matz, and Javier Vargas-Johnson. <br /> Also present were Jen Mete, A.G. for the Commission, and Emilie Polley, and <br /> MacKenzie Herman A.G. for Staff. <br /> Commissioner Pautler called for agenda item no. 2, Review and approval of agenda <br /> Items, the agenda was approved as presented. <br /> Commissioner Pautler called for agenda item no. 3, Approval of the minutes for <br /> the meeting of May 16, 2025, Commissioner Pautler asked if there were any <br /> corrections or additions to the minutes, after noting that on page 9 of the Republican <br /> River Water Conservation District Report, "Ms. Talbert" should be changed to "Ms. <br /> Daniel". <br /> Considering the correction above mentioned by Commissioner Pautler, <br /> Commissioner Denning moved to approve the minutes with incorporation of the <br /> correction. <br /> Commissioner Diaz seconded the motion which carried unanimously. <br /> Commissioner Pautler called for agenda item no. 4, Report of the Executive <br /> Director by Jason Ullmann. <br /> Mr. Ullmann opened his remarks by mentioning the State of Nebraska filed a <br /> complaint with the Supreme Court against the State of Colorado on July 16th. Mr. <br /> Ullmann further explained that the complaint is requesting the Supreme Court accept <br /> the case against the State of Colorado, which is related to South Platte River Compact <br /> compliance and the proposed Perkins County Canal. The State of Colorado has until <br /> October 15th to respond to the complaint, which will be made public. A public <br /> meeting was recently held in Julesburg, Colorado to help citizens better understand <br /> the Supreme Court process and timing. Mr. Ullmann reminded the Commission that <br /> these cases can take several years to resolve, and can take a year or so for the <br /> Supreme Court to decide if they will accept the case. <br />
