Ground Water Commission Meeting Minutes Page 16 <br /> August 14 Ft 15, 2025 <br /> Commissioner Keeler commented that he liked how Rule 13 was written as-is, <br /> and it may cause issues with Staff receiving multiple unique forms from <br /> different Objector's Attorneys, rather than one standardized form provided by <br /> the Commission. <br /> Ms. Mete wondered if the customized forms would be limited to Objectors <br /> represented by Counsel, or if pro-se parties could also use customized forms. <br /> Mr. Jones responded that he believed limiting customized objection forms to <br /> parties represented by Counsel would probably be best practice, but he is open <br /> to discussion about it. <br /> Commissioner Pautler agreed that some good points have been raised, and <br /> thought it may be beneficial to clarify in the form that it might be too soon in <br /> the process for an Objector to always be able to state their basis of objection <br /> without knowing all the facts regarding the application. <br /> Commissioner Payne asked if water quality would be considered impairment or <br /> injury. <br /> Mr. Jones thought water quality could be considered impairment. <br /> Ms. Sarah Brucker thought that an objection related to water quality could be <br /> accepted, and left to the Hearing Officer for a decision. <br /> Commissioner Hume and Commissioner Diaz thought that moving this agenda <br /> item to November would be beneficial, so that all Commissioners could be <br /> present for the discussion. <br /> Ms. Mete mentioned she will work with Commissioner Noble on some additional <br /> edits and review for the proposed rule changes in preparation for discussion at <br /> the November meeting. Mr. Jones added that he would be willing to send over <br /> written comments to Ms. Mete and Commissioner Noble. <br /> c) Process for amending erroneously issued Determinations of Facts: <br /> Ms. Sarah Brucker representing Staff addressed the Commission, and reminded <br /> the Commission that this agenda item includes situations where Determinations <br /> of Facts were issued erroneously on lands that were not owned by the <br /> Applicant. Staff has proposed a pathway for correcting determinations in these <br /> situations. DWR would first request evidence showing the determination was <br /> issued in error. If it was agreed that the determination was erroneous, Staff <br /> will complete form GWS-67A (Application to Correct a Determination of Water <br /> Right) for each determination, and the Commission will pay the cost of the <br />
