July]o205
Page 4of4
Q: My decree for my water right doesn't include any requirements for me to measure my
diversions. Du | still have to comply with the Measurement Rules?
/\: Yes' Under their statutory authority to require measurement, DYYR may require more
stringent measurement requirements than included in a water court decree. Likewise, a
water court decree may include more stringent measurement requirements than included in
the Measurement Rules, and u water user would need to comply with those decree
requirements. In most of those instances, compliance with the decree requirements is also
likely to be sufficient under the Measurement Rules. In the unlikely event n water court
decree conflicts with the Measurement Rules, that will need to be addressed on o case-by-
case basis, and m variance under Rule 11 might beappropriate.
[X How did DVVRpnovide notice ofthe ru(emmahjn0 process to water rights holders?
A: !n April and May ZO25' DVYR held stakeholder meetings throughout Division 4inDelta,
Gunnison, Norwood, and Montrose. Virtual options were made available for all four meetings
to accommodate more schedules and to solicit wider input from the public to provide
feedback, and a recording of one of the meetings was made available on the DYYRvvebsiLe.
Notice of those meetings was advertised and posted on DVYR`svvebpage for Division 4, and
prior to the meetings email notices were sent to all persons on the Division 4 Substitute Water
Supply Plan notification list. Water Commissioners and water user organizations also helped
spread the word about the Rules. The draft Rules have been publicly available since March 25,
2025, and interested parties were given until May 31 to provide written comments' In addition
to this stakeholder process, as required under statute (§ 37-92'501/I\(g)' C.R.S.}, DVYRvviU
file the Rules in the Division 4 Water Court, and the Rules must be published in newspapers in
each county in Division 4.
Q: I tried attending one of the stakeholder meetings virtually but had a difficult time
hearing the audio.
A: 4 recording of one nfthe stakeholder meetings is available onhne at
https://vvvvvv'ynutube'conm/vvatch/v~ri4sRR65|uvv.
/54/ Oxuo° D,ivr. 5ui/c |uz5. wmntmsc, coa11o1 p970219.6622 dr.co|orado,gov
m,rus.
