If the pond is not
located ona natural stream (Rule 4.1.1] defines "Off'5[ream Reservoir"), Rule d.1.9 for Off-
Stream Reservoirs applies. Under that Rule, the augmentation pond must be equipped with
two of the following, as further described in that Rule: measurement at the point of Diversion
for the structure used to deliver water to the pond (for example, the rive[ headgate for a
ditch), measurement of the volume of water in storage, or measurement of releases from the
pond. Measurement nfreleases is therefore not required for every augmentation pond. Also,
if the measurement of the volume of water in storage (Rule 8'1'9'2> can be used to calculate
the change in storage volume (vvhichvviii usually be the case), that measurement is also
sufficient to measure Diversions to the pond under Rule 6'1.9'1 and releases from the pond
under Ruieb'1.9.3, os tong as deliveries tnand releases from the pond are not being made at
the same time. (Measurement nfdiversions toor releases from the pond by calculating the
change in storage isan Alternative Measurement Method subject to approval under Ruie7.4.)
Cl: Will the State pay for the installation of Measuring Devices and Headgates required
under the Rules?
A: Under state statute, § 37-04'112' ['R.S'' water users are responsible for installing and
maintaining headgates and measuring flumes, weirs, and devices. 5tjii' the State has secured
$7 million in funding to assist Western Slope water users with the installation of measuring
devices. More information on hnvv to apply for that assistance wit[ be provided later this year.
Q. Rule 6.1.1 mentions "defining elements of a Diversion Structure's Water Right(s).
What are "defining eienngnts"?
/\: As used in this Rule, "defining eiemncntn" refers to whether the Water Right can be
described in terms ofrate of diversion (typically cubic feet per second (cfo)) or volume
(typically acre feet). For example, n direct f tow Water Right will typically be measured in
terms of Finvv Rate, and a storage Water Right will typically be measured in terms ofvolume.
Q: How am I supposed to comply with the measurement method functional standards
under Rule 8.1?
A: To comply with the Rules, a Measurement Method must be "designed tn" meet the
functional standards under Ru|esb.1.Z, 8'1'3' Vrb.1'4. 4 Measurement Method must also be
installed property (Rule 6'1.0) and be maintained (Rule 6.1.7). |faMeasuring Device is
installed property and maintained as described in Ruie6.4'1' the Division Engineer will.
presume that it meets the functional standards described in Rules 6'1'Z, 6'1.3, or6'1.4. The
Division Engineer may still rate or Verify any Measurement Method if appropriate under Rule
6.4.2.
/ow VxuvD,wn, Suite/61x, Montrose, cou)4o| p97D2ip,uo2Z dwrzvivrad*.gov
