NEW RULE 5.1.4.1. Commission Staff must include a deadline for filing objections to the application in all <br /> publications of applications filed pursuant to this Rule 5. Any objection to the application is subject to <br /> Rule 13. <br /> REVISION TO RULE 7.2. Publication - Except as noted in this section, applications for Changes of Water <br /> Rights to designated ground water shall be published in accordance with section 37-90-112, C.R.S.The <br /> Commission Staff shall act upon an application, or a resubmitted application,within sixty days of the <br /> receipt thereof. An incomplete application shall be returned to the Applicant with an explanation; this <br /> shall be deemed action by the Commission Staff.An application that is found to be complete and <br /> requires a publication, shall be submitted to the appropriate newspaper for publication; which shall also <br /> be deemed action by the Commission Staff. Publication does not require a favorable finding by <br /> Commission Staff and no such indication shall be made.The publication shall indicate (a)the name of <br /> the Applicant, (b)the well permit number, presently permitted annual volume, presently permitted <br /> pumping rate, presently permitted well location, and presently permitted irrigated land or other <br /> appropriate description of type of use for each well included within the application, and (c) a general <br /> statement describing the changes requested by the Applicant.The publication shall also indicate the <br /> deadline and location for filing any objections to the application. Any objection to the application is <br /> subject to Rule 13. <br /> NEW RULE 13. An objection to an application filed pursuant to Rule 5 or Rule 7 of these Rules, and an <br /> objection to a notice of proposed issuance of a final permit pursuant to section 37-90-108 C.R.S. must: <br /> (A) be submitted on the form identified by Commission Staff, <br /> (B) reference the application and the well structure(s)that are the subject of the objection, <br /> (C) clearly state the basis for the objection. and <br /> 1. if the basis for the objection is injury to a well or water right, specify the name and <br /> location of the well or water right. <br /> 2. for objections to applications for new appropriations, clearly state if the objection is <br /> based on a claim that the appropriation would unreasonably impair existing water rights or <br /> create unreasonable waste though an objection to a new appropriation need not be based on a <br /> claim of unreasonable impairment to an existing water right or creation of unreasonable waste, <br /> and <br /> (D) be verified by the objector consistent with section 13-27-106, C.R.S. <br /> This rule is not intended to limit participation of Ground water management districts formed pursuant <br /> to section 37-90-118 to 135, C.R.S. and such districts may file objections, however must submit the <br /> objection on the designated form. Commission Staff may dismiss an objection if it is does not comply <br /> with provisions (A), (B), and/or(D) of this Rule 13.The Commission or the Hearing Officer may dismiss <br /> an objection that does not comply with provisions (A)—(D) of this Rule 13, and may do so on their own <br /> initiative without a motion from one of the parties. If Commission Staff,the Commission, or the Hearing <br /> Officer dismisses an objection because the objection does not comply with the requirements of this Rule <br /> 13,the dismissal must state the grounds for dismissal and provide for the opportunity for the objector <br /> to correct the objection's deficiencies within ten (10) days of receiving the Order of Dismissal.The Order <br />
