Mr. Jones clarified that the responses <br /> he has heard about why 13(C) was written the way it was is to help everyone <br /> involved better understand the basis of an objection. Mr. Jones emphasized <br /> that he wants to make sure that objections which don't include unreasonable <br /> impairment or waste as a basis would not be immediately dismissed under the <br /> draft rule changes. <br /> Ms. Mele responded that the intent of item 13(C) is not to limit objections and <br /> question the standing of an objector, but to better understand the nature of <br /> the objection. <br /> Mr. Jones commented that so long as objectors are allowed to make objections <br /> on a basis other than unreasonable impairment or waste, the changes seem <br /> reasonable from a due process point of view. <br /> Acting Chairman Noble commented that he thought that instead of the red <br /> lined language under item 13(C), changes could be made to the draft rule that <br /> make it clear other reasons other than unreasonable impairment or waste are <br /> allowable as a basis of objection. <br /> Mr. Jones agreed that this approach would be a positive improvement. <br /> Acting Chairman Noble commented on the draft new Rule 13 section that <br /> allows Ground Water Management Districts to file an objection and participate <br /> in a case for any reason. More specifically, Acting Chairman Noble wondered if <br /> that statement was too broad and if it this language could be revised to be <br /> narrower. <br /> Ms. Mele responded that she also viewed this language as being too broad, but <br /> it was incorporated based on requests from the districts. Ms. Mele was open to <br /> revisions if anyone had any ideas for ways to improve this section of draft new <br /> Rule 13. <br /> Ms. Kosloff asked if districts were held to a different standard when submitted <br /> objections. <br /> Ms. Mele responded that districts are required to fill out the same form as <br /> other objectors. <br /> Acting Chairman Noble and Ms. Mele agreed that this section could use some <br /> refinement. <br />
