Ground Water Commission Meeting Minutes Page 19 <br /> November 15, 2024 <br /> maximum circulation, and meet statutory requirements. <br /> Ms. Williams clarified that Staff normally does not coordinate in advance with <br /> Applicants regarding which newspapers are used to provide notice of their <br /> application. <br /> Ms. Mete highlighted statutory requirements to publish notice in a newspaper of <br /> general circulation in the county that a well is located in, and also a <br /> requirement to be published in a newspaper available by mail. <br /> Chairman Arnusch asked if any Commissioner were opposed to directing Staff to <br /> publish notice applications in Prowers County in both in The Kiowa County <br /> Independent and The Prowers Journal. No opposition was made, and the <br /> Commission directed Staff to publish in both newspapers. Chairman Arnusch <br /> asked the Southern High Plains Management District to help water users <br /> understand where to find notices in the District going forward. Commissioner <br /> Hume agreed that most interested parties would transition fairly easily to the <br /> new publication locations. <br /> Commissioner Noble, Mr. Ullmann, and Mr. Pearson commented that it is <br /> possible to work toward introducing new legislation to change notification <br /> requirements for applications. <br /> Chairman Arnusch called for agenda item no. 12, public comment. <br /> Ms. Sarah Brucker representing DNR addressed the Commission, and brought to their <br /> attention an issue regarding past issuance of determinations of ground water rights to <br /> Applicants that did not own all of the overlying land included in the determination <br /> applications. Ms. Brucker mentioned that to correct these issues, a new application <br /> for a change in the determination of water right is required but it is unclear which <br /> party should submit that application. Ms. Brucker then asked the Commission if the <br /> Commission or Staff should be the Applicant in these circumstances, and if the <br /> Commission is comfortable with that approach. Two new determination applications <br /> have been submitted for review which are facing this issue. <br /> Chairman Arnusch, Commissioner Denning, and Mr. Ullmann commented that the <br /> determinations would need to be corrected, and this discussion should be added as an <br /> agenda item for the February meeting. <br /> Mr. Curtis then addressed the Commission and provided comments related to agenda <br /> item no. 13, executive session - Southern High Plains Objections. Mr. Curtis <br /> mentioned he had been involved with cases in the Southern High Plains experiencing <br /> frivolous objections that have taken up significant time and resources.
