Ground Water Commission Meeting Minutes Page 17 <br /> November 15, 2024 <br /> Ms. Herman and Ms. Mete mentioned that this would need more research. <br /> Commissioner Tietmeyer asked if a publication would be needed in all cases <br /> where a correction was being made. <br /> Ms. Herman responded that parties of interest and the well owner would need <br /> to be provided notice, but publication would likely not be necessary. <br /> Commissioner Tietmeyer asked who would be able to interpret what is a <br /> clerical error and what is a substantial change to a permit. <br /> Ms. Herman responded that her office is working to ensure there are no <br /> loopholes in a proposed rule change to prevent alterations to permits beyond <br /> addressing clerical errors, and it would likely be up to Staff during review to <br /> determine if the change would be considered a clerical error or not. <br /> Chairman Arnusch called for agenda item no. 11, new business. <br /> 1) Upper Crow Creek Ground Water Management District petition to correct the <br /> district boundaries. <br /> Mr. Andy Jones addressed the Commission, and began his remarks by requesting <br /> a correction to the boundaries of Upper Crow Creek. Mr. Jones provided some <br /> background information on the creation of the District, which involved an error <br /> where some parcels of the District were excluded in the Director of Divisions <br /> document. Mr. Jones requested a motion that the Director of Divisions <br /> document be corrected to match the correct legal descriptions contained in the <br /> District legal description and map documents. Mr. Jones noted that this motion <br /> does not change the District boundary, but instead corrects an error contained <br /> in the Director of Divisions document. Mr. Jones mentioned that there were no <br /> objections to the creation of the District, and no publication has been made for <br /> the correction. <br /> Commissioner Keeler moved to approve the request to correct the District <br /> boundaries. <br /> Commissioner Diaz seconded the motion, which carried unanimously. <br /> 2) Newspaper for publications of legal notices in Prowers County. <br /> Ms. Joanna Williams addressed the Commission, and began her remarks by <br /> informing the Commission that the newspaper used for publications in Prowers <br /> County (The Lamar Ledger) has recently ceased publication.
