Ground Water Commission Meeting Minutes Page 10 <br /> November 15, 2024 <br /> proposed plan is as effective as pumping the replacement water and measuring it, <br /> then pumping it back into the aquifer for recharge. Mr. Sanchez also clarified that <br /> there would be no pipeline involved in either scenario. <br /> Commissioner Keeler asked Mr. Sanchez if another well would be required as part of <br /> the process to inject the replacement water back into the aquifer. <br /> Mr. Sanchez responded that there would need to be some work done for the injection <br /> site, and another well may need to be constructed due to the age of the existing well. <br /> Commissioner Pautler requested clarification on if the rule would only require the <br /> replacement water to be pumped, measured, and injected back into the aquifer at <br /> the same location, and not transferred to the Ballyneal pumping site. <br /> Mr. Sanchez affirmed that this is what the rule requires. <br /> Commissioner Noble asked Mr. Sanchez where in the rules does it not require the <br /> replacement water be transferred to the location where the new wells will operate. <br /> Ms. Jen Mete suggested that this question has more pertinence to the replacement <br /> plan and not necessarily with the variance request. <br /> Mr. Curtis reiterated that he believes the current rules only require the replacement <br /> water be recharged at the site where the replacement water is being measured. <br /> Chairman Arnusch asked the Applicant's representatives to discuss more about their <br /> claims of unusual hardship, and not necessarily undue burden. <br /> Mr. Curtis replied that the unusual hardship is the requirement to spend money to <br /> comply with the rules, but not achieving any added value by doing so. <br /> Commissioner Pautler asked where the proposed water level monitoring program <br /> would take place. <br /> Mr. Sanchez responded that the monitoring program would take place at the location <br /> of the replacement water. <br /> Commissioner Noble noted that the rules require the replacement plan to protect <br /> against injury to other water users, and it seems that not replacing the water at the <br /> location where depletions are occurring could injure other users. <br /> Mr. Sanchez replied that their analysis has shown there would not be an impact to <br /> water users through pumping of the new wells for the gold course. <br /> Commissioner Noble remarked that the review and publication of the replacement <br /> plan would give other water users the ability to provide their own analysis showing <br />
