BOE Meeting Minutes <br /> August 13, 2024 <br /> Page 8 <br /> A. The Board returned from executive session at 1:23 PM. The discussion in executive <br /> session was limited to: conferences with the Board's attorney concerning disputes <br /> involving the Board that are the subject of pending or imminent court action, concerning <br /> specific claims or grievances, and for the purpose of receiving legal advice on specific <br /> legal questions. The matters discussed were limited to the topics announced before going <br /> into executive session. No adoption of any proposed policy, position, resolution, rule, <br /> regulation, or formal action occurred during executive session. <br /> XIII. Old Business <br /> A. Einhellig/Born - permit 302045 - abandonment review <br /> 1. Andy Flor provided an update on the situation <br /> 2. No action needed <br /> B. By-Laws <br /> 1. Robert Hillegas provided comments <br /> a) Section A, Note 6 - Does not address the longer terms of the State <br /> Engineer's Representative and CDPHE Representative. There could be <br /> another statement regarding this. <br /> b) Article II, Section B, Item 1 - Term limit should be opened up <br /> (1) Mr. Sanchez also disagreed with the strict nature of this By-Law <br /> (2) Board generally agreed that language should be modified to <br /> allow for the Board to reconsider appointments every year. <br /> c) Article III, Section A - Should language be opened up to allow more <br /> frequent meetings elsewhere <br /> (1) Jen Mele stated that language allows for this, but that it <br /> follows the language of the statute. <br /> d) Article III, Section D, Item 7 - Asked who is the judge for "sufficient" <br /> data <br /> (1) Jen Mele stated this is related to the statute <br /> 2. Chris Sanchez provided comments <br /> a) Article III, Section B, Item 4 - It might be more appropriate to contact <br /> the State Engineer first <br /> b) Article III, Section B, Item 2 - Language detailing the notice being <br /> posted on the front door should be removed. <br /> 3. Jason Ullmann provided comments <br /> a) Asked if the position of the Secretary of the Board is okay being <br /> included in the By-Laws since it is not stated in statute <br /> (1) Jen Mele confirmed that it is okay and has historically been a <br /> position in the Board <br /> b) Suggested to remove "periodically" from the bottom of page 2 <br /> (1) Kevin Donegan responded that this language is in statute <br /> 4. Jen Mele suggested a few changes to typos included in the document. <br /> C. DRAFT BOE Policy 2024-1 Filter Pack Above Confining Layers in Type 1 Wells <br /> **striket.hrouh denotes Item was not discussed at. this meeting <br />
