BOE Meeting Agenda <br /> October 1, 2024 <br /> Page 7 <br /> e) Stated that Type II over Type II would really harm drillers in his area <br /> since the overlying aquifer is often dry and karst topography would <br /> make it impossible to follow those proposed rules <br /> (1) Kevin Donegan stated that Staff is working on these rules <br /> f) Requested that Rule 14 discuss dewatering wells <br /> (1) Chris Jones clarified that the new rules state that dewatering <br /> wells must comply with Rule 14 <br /> (a) Mr. Day responded that Rule 14 does not mention <br /> dewatering rules <br /> g) Agreed with Tim Kunau that cement pads are not useful <br /> 5. Josh Weaver <br /> a) Stated that, based on what he has read, recommendations on annular <br /> space refer to gravel pack rather than grout. <br /> b) Stated that well drillers are beginning to feel like engineers are not put <br /> under as much scrutiny as drillers <br /> c) Asked that Staff and Board consider whether they are taking actions as <br /> government agents which want to protect the resources of Colorado or <br /> as "politicians" with a personal agenda <br /> 6. Todd Hunter <br /> a) Stated that he believes the Office of the State Engineer has the <br /> resources to pursue an increase in the well inspection program <br /> (1) John Hunyadi stated it is difficult to get action items moved <br /> forward, but he is working with Kevin Donegan to improve the <br /> well inspection program <br /> 7. Chris Sanchez asked what Staff needs to move on with the Rulemaking process <br /> a) Chris Jones and Kevin Donegan stated that Staff will create a draft <br /> based on board comment to move forward into the official rulemaking <br /> process <br /> X. Review of Active Complaints and Settlement Recommendations <br /> A. Requested Board Action <br /> 1. 23-BC-004, Robert Young, Lic 592; Permit 319985; Construction Violation - Failure <br /> to Repair Well per Stipulated Settlement and Board Approved Variance within <br /> Allotted Time Frame - Request BOE Set Hearing. <br /> a) Chris Jones provided information regarding this complaint <br /> b) Discussion regarding timeline of complaint and possible action <br /> c) Chris Sanchez motioned to direct Staff to schedule a hearing in case <br /> 23-BC-004. Robert Hillegas seconded.
