(exempt wells)the completion of well construction is accomplished on-or <br /> beforeprior to the permit expiration date; or, (2) for all other wells (non-exempt wells), <br /> the completion of well construction or pump installation is accomplished on or before the <br /> permit expiration date. The State Engineer has the exclusive administrative authority to <br /> determine whether or not a well permit is valid. <br /> 5.2.56 <br /> 5.2.58 "Water well supply system" includes all components of a groundwater well, pump, drop <br /> pipe, pitless adapters or units, other pumping equipment, storage tanks or cisterns, and <br /> piping and connections between the well and its point of discharge from the pressure <br /> tank, if such a tank is installed. <br /> 5.2.59 5.2.57 "Watertight" means a condition that does not allow the entrance, passage, <br /> or flow of water under normal operating conditions. <br /> 5.2.58 <br /> 5.2.60 "Well" as used in these Rules, "means any test hole or other excavation that is drilled, <br /> cored, bored, washed, fractured, driven, dug,jetted, or otherwise constructed for the <br /> purpose of location, monitoring, dewatering, observation, diversion, artificial recharge, <br /> or acquisition of ground watergroundwater for beneficial use or for conducting <br /> pumping equipment or aquifer tests." § 37-91-102(16)(a), C.R.S. <br /> 5.2.60.1 5.2.58.1 "Well", as used in these Rules, does not include "an <br /> excavation made for the purpose of obtaining or prospecting for minerals or <br /> those wells subject to the jurisdiction of the oil and gas conservation <br /> commission, as provided in article 60 of title 34, C.R.S., or those wells subject to <br /> the jurisdiction of the office of mined land reclamation, as provided in article 33 <br /> of title 34, C.R.S." § 37-91-_102(16)(b)(I), C.R.S. <br /> 5.2.58.2 <br /> 5.2.60.2 "Well", as used in these Rules, "does not include a naturally flowing <br /> spring or springs where the natural spring discharge is captured or concentrated <br /> by installation of a near-surface structure or device less than ten feet in depth <br /> located at or within fifty feet of the spring or springs' natural discharge point and <br /> the water is conveyed directly by gravity flow or into a separate sump or <br /> storage, if the owner obtains a water right for such structure or device as a <br /> spring pursuant to article 92 of this title." § 37-91-102(16)(b)(II), C.R.S. <br /> 5.2.59 <br /> 5.2.60.3 "Well", as used in these Rules, does not include wells constructed <br /> specifically for cathodic protection, a technique to prevent corrosion of a metal <br /> surface by making that surface the cathode of an electrochemical cell, as <br /> provided in Department of Labor and Employment, Division of Oil and Public <br /> Safety, Underground Storage Tanks and Aboveground Storage Tanks (7 CCR <br /> 1101-14). <br /> 5.2.60.4 "Well" as used in these Rules, does not include an injection well or <br /> wells used to emplace a carbon dioxide stream beneath the lowermost <br /> formation containing an underground source of drinking water(USDVV); or wells <br /> used for geologic sequestration of carbon dioxide that have been granted a <br /> waiver of the injection depth requirements pursuant to requirements at§ 146.95; <br /> or,wells used for geologic sequestration of carbon dioxide that have received <br /> an expansion to the areal extent of an existing Class II enhanced oil recovery or <br /> enhanced qas recovery aquifer exemption pursuant to §§ 146.4 and 144.7(d) of <br /> this chapter. It includes the subsurface three-dimensional extent of the carbon <br /> dioxide plume, associated area of elevated pressure, and displaced fluids, as <br /> well as the surface area above that delineated region (40 CFR 146 Subpart H - <br /> Criteria and Standards Applicable to Class VI Wells (2010)). <br /> 5.2.60.5 "Well" as used in these Rules does not include wells associated with <br /> Deep Geothermal Operations. Deep geothermal operations means any <br /> exploration for or production of allocated geothermal resources or geothermal <br /> resources that are deeper than two thousand five hundred feet below the <br /> surface.
