The documents required to be submitted in Rules <br /> 5.C.2)b) and c) are the documents required by statute to support the <br /> application. Rule 5.C.2)c) was changed to require the submittal of a <br /> certified copy, of the ordinance or resolution. <br /> Rule 5.5. repeats the statutory requirement of the submission of a fee <br /> with the application for a permit (currently $25.00) . <br /> Rule 5.E. was added to require that .tho applicant or his agent sign and <br /> date the application and certify the truth of the information set forth <br /> thereon. <br /> Rule 5.F. was added to clarify that Rule 5 does not apply to <br /> applications submittted before the effective date of these rules. <br /> Rule 6 <br /> Rules 6.A. and B. specify the procedures to be utilized by the State <br /> Engineer, in issuing or denying a well permit. They ens'ure that such <br /> procedures will be uniform and clarify the number of copies of a permit <br /> that will be mailed and their distribution. Rule E.A. also allows the <br /> State Engineer to reserve the determination of the allowed average annual <br /> amount of withdrawal until after the well has been constructed, in the <br /> event insufficient information is available at the time of permit <br /> issuance. Rule 6.A. was changed to include private drillers and private <br /> pump installers. <br /> -Rule 6.,&. as --originally proposed was much critici-zed--bec-ause- it -provided <br /> that an incomplete permit application would be denied. Most parties <br /> thought that an applicant should be given notice of any deficiencies ana a <br /> reasonable opportunity to cure them. The State Engineer agreed with these <br /> comments and has changes, the rule to provide for notice ana an opportunity <br /> to cure. Failure to cure will result not in a substantive denial , but in <br /> return of the application ana forfeiture of the fee. <br /> Rule 7 <br /> Rule 7.A. requires the submission of notice by the permittee that the <br /> ( T <br /> well has been completed as required by Section 37-90-137(3) (a) <br /> C.R.S. This notice informs the State Engineer wnen a permitted we'll has <br /> beer constructed, whether it was constructed by a licensed water well <br /> contractor, and provides the State Engineer with other relevant <br /> information concerning" the well .
