Geothermal Rules <br />Effective Date: September 30, 2004 <br />hearing in accordance with the State Engineer's Procedural Regulations, 2 CCR 402-5 <br />(1984). In an adjudicatory matter concerning a geothermal well, the final action of the <br />State Engineer shall be subject to judicial review by the court having authority over the <br />area in which the well is located. <br />RULE 7 CERTIFICATION <br />7.1 To safeguard life, health, property, public welfare and the environment, the State <br />Engineer requires all individuals who intend to construct or supervise the construction of <br />loop fields for geoexchange systems to become "certified individuals", as defined in <br />Rule 4.2.4, prior to commencing such construction. <br />7.2 An application prescribed by the State Engineer shall be submitted to the <br />Division of Water Resources by each individual who seeks to become a certified <br />individual. <br />7.2.1 The application shall include the following information at a minimum: <br />a. applicant's name, mailing address, and telephone number(s); <br />b. applicant's company name, mailing address, and telephone number(s); <br />C. a copy of the individual's or company's insurance or bond under which the <br />work will be performed. <br />7.3 An individual applying for certification shall provide the number of years of <br />experience in performing either drilling, excavating, backfilling, or grouting, or <br />supervising these procedures. <br />7.4 An individual who has submitted an acceptable application for certification shall <br />successfully pass a written examination prescribed by the State Engineer. The <br />examination shall assess the applicant's familiarity and understanding of these Rules <br />and pertinent statutes. A score of seventy (70) percent or better shall be required to <br />pass the written examination. <br />7.4.1 Upon written request, the State Engineer may waive the written <br />examination requirement for an individual who is seeking reactivation of an expired <br />certification. <br />7.5 Based upon an individual's application and written exam results, the State <br />Engineer may require that the applicant appear for an oral examination. Such oral <br />examination shall be in addition to the written examination. <br />7.6 An applicant requesting certification shall demonstrate adequate financial <br />responsibility (insurance, compliance bond, or alternative funds) in an amount of at least <br />17 <br />
