The WQCC will <br />request that the SEO and CWCB determine whether, if adopted, the decision, <br />rule, or policy pending before the WQCC may or would result in a diminution of <br />the available water supply that a water rights holder would otherwise enjoy at. <br />the time and place and in the amount of demand for beneficial use when <br />operating in accordance with the holder's vested water right. <br />b. In making this determination, the SEO and CWCB will review the information <br />submitted on the record to the WQCC regarding the decision, rule, or policy in <br />question. The SEO and CWCB may also, in their discretion, request additional <br />documentation from parties to the matter in front of the WQCC, meet with <br />such parties, or conduct additional research. <br />c. Prior to the date on which the WQCC is scheduled to take action on the <br />decision, rule, or policy in question, the SEO and CWCB shalt provide a response <br />regarding whether they believe the decision, rule, or policy may or would <br />result in a diminution of the available water supply that a water rights holder <br />would otherwise enjoy at the time and place and in the amount of demand for <br />beneficial use when operating in accordance with the holder's vested water <br />right and will provide that response in writing to the WQCC. <br />d. If the SEO and CWCB believe that the decision, rule, or policy may or would <br />result in a material injury to water rights, the WQCC will consult with its <br />attorney regarding how to proceed with the decision, rule, or policy, <br />recognizing that the Water Quality Control Act states "The question of whether <br />such material injury to water rights exists and the remedy therefor shall be <br />determined by the water court."
