Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your Notice of Intent to Conduct Prospecting on September 09, 2009. A <br />letter was sent to you stating that the application was determined to be substantially incomplete <br />and inadequate with a couple of small exceptions. That letter also informed you that if you did <br />not adequately respond to those concerns that were identified as incomplete or inadequate within <br />60 days, the notice would be terminated. The date for responding to those concerns was <br />December 5`", 2009. Since you have not submitted additional information addressing the <br />previously identified inadequacies, this letter shall serve as notice that File P-2009-028 is hereby <br />terminated. <br />In accordance with Rule 1.4. 11 any person who can demonstrate that he/she/it is directly or <br />adversely affected or aggrieved by an action of the office and whose interests are entitled to legal <br />protection under the Act may petition the Board on such action within sixty (60) days of the date <br />of the office decision if the office decision was a denial, without a hearing, of an application for a <br />permit or a Notice of Intent. A copy of Rule 1.4.11 is included with this letter to assist you if you <br />wish to file a petition on this notice of termination. <br />Please be advised that you have until March 28, 2010 to petition for a hearing before the Mined <br />Land Reclamation Board in accordance with Rule 1.4.11(1)(d).
