Cattany <br />Division Director <br />Natural Resource Trustee <br />61---- L__-? <br />RE: Update on Powertech's proposed modification MD-02 to Notice of Intent No. P-2008-043 <br />I have attached the letter from the Division of Reclamation, Mining and Safety ("Division") to Powertech <br />regarding Powertech's proposed modification MD-02 to Notice of Intent (NOI) to Prospect No. P-2008- <br />043. <br />Under the original NOI and modification MD-01 to the NOI, Powertech will drill wells to conduct an <br />aquifer pump test. The modification addresses how to dispose of water from such a test. The modification <br />MD-02 only addresses disposal of the water from the test and not the conduct of the test itself. <br />At this time, the Division finds Powertech's proposed modification incomplete. The Division's letter sets <br />forth a list of items to which Powertech must respond, including specifically addressing the letters sent by <br />Weld County officials and the Western Mining Action Project regarding their concerns about the <br />proposed modification. These letters are attached to the Division's letter. <br />By regulation, Powertech has 60 days to submit the requested information (unless the Division approves <br />an extension). <br />The Division will keep you informed of the status of Powertech's modification request, including any <br />response received from Powertech. <br />Please let us know if you have any questions regarding this matter. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
