Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
RE: Update on Powertech's proposed modification MD-02 to Notice of Intent No. P-2008-043
I have attached the letter from the Division of Reclamation, Mining and Safety ("Division") to Powertech
regarding Powertech's proposed modification MD-02 to Notice of Intent (NOI) to Prospect No. P-2008-
043.
Under the original NOI and modification MD-01 to the NOI, Powertech will drill wells to conduct an
aquifer pump test. The modification addresses how to dispose of water from such a test. The modification
MD-02 only addresses disposal of the water from the test and not the conduct of the test itself.
At this time, the Division finds Powertech's proposed modification incomplete. The Division's letter sets
forth a list of items to which Powertech must respond, including specifically addressing the letters sent by
Weld County officials and the Western Mining Action Project regarding their concerns about the
proposed modification. These letters are attached to the Division's letter.
By regulation, Powertech has 60 days to submit the requested information (unless the Division approves
an extension).
The Division will keep you informed of the status of Powertech's modification request, including any
response received from Powertech.
Please let us know if you have any questions regarding this matter.
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
