On <br />July 22, 2013 the Division sent an adequacy letter to Colowyo Coal Company indicating that we were concerned <br />that the new design does not contain a revised geotechnical analysis. On August 14, 2013 we received Colowyo's <br />response to our adequacy issue, including a letter from Mark Gray of Shannon & Wilson (Coorado P.E. 22804) <br />stating that in his professional opinion the revised plan will not adversely affect the stability of the East Taylor <br />Fill. <br />The Division agrees with Mr. Gray's assessment, and we have no further issues regarding TR -99. However, a <br />portion of the slope will be steeper than the original plan, and (while this would have no effect to the overall stability <br />to the entire South Taylor Fill) this area could have the potential for smaller slumps along the surface.
